Hello,
Can anyone here help with some advice on my forthcoming unlimited leave to remain Visa?
We got married Dec 2006, and received my residence permit limited leave to remain visa last Feb 2007 and it will run out on Feb 2009.
But i had to leave last Nov 07 back to PI because my husband was work abroad, and i chose to be with my family, and when my husbands contract was finish we decided to come back to the UK, Aug 08. When we contact the home office before i arrived in UK asking about my visa, they told us that i need to apply for an extension visa??? ( which is getting me confused )
Now im all confused what will happen next, because we tried to email them but until now they have not answered, so will I still qualify in applying for a residence permit unlimited leave to remain?
Does anyone have advice regarding my situation???
I will appreciate all and any advice..:)

In your previous post you mentioned there about how long you've stayed in the PI. Since youve been away more than the allowed time they required that is why they asked you to apply for an extenson. You have to stay in the UK for 2 yrs before you can apply for ILR.

Im holding limited leave to remain right now Tin and will apply for settlement visa ( ILR or unlimited leave to remain) early next year too.
Hope the HO will contact u soon.

in ur case i think u need to extend ur visa (flr)after u have extended
ur visa completed your 2 years in uk you can apply for your ILR..
u need to pass the" life in the uk test" before you apply for ILR.

ah, did you already take the test for the ILR?
hope so they will contact me sooner rather than latest so i can do my bits and finish this visa thing out in our way, so we dont have a thing to worry about living here. hehehe

in ur case i think u need to extend ur visa (flr)after u have extended
ur visa completed your 2 years in uk you can apply for your ILR..
u need to pass the" life in the uk test" before you apply for ILR.
yes, tnx alicat for the advice, my friend who lives in cumbria took her test last july and passed, but her visa will runs out around april or may next year, is that ok, taking her test to quick??

you can take your test anytime b4 you apply for ilr :xxgrinning--00xx3:

actually,i take my test 5 mounths ago,but my visa expired
this coming october...you can take your test anytime.

hi tin the HO said you need to apply extension visa instead of ILR bcoz of your absences here in uk,how many months you stay in PI? i think you need to cover up your absences before you apply the ILR

i stayed in PI for a good 9 months, but i just remembered that we are allowed for a 3 months out in uk if we are holding the limited leave to remain? correct me if im wrong.. and i tried to look in the net last night, and i cant find a proper application form for my exension visa, what im thinking is im going to apply for a new flrm?? i wish not..:doh
again correct me if im wrong... tnx for the help though guys..:)

I dont need to apply vbkelly, thank God, my husband just phoned the HO, and they told us that, as long as you prove that you have cohabited together it should not be a problem. So im going to apply for my ILR now in October, woohhooo... tnx to you guys for all the advices...

there is no set figure, but 90days is seen as a safe figure, but 9 months, well see below as you were not living together, and your asked on the set (m) form if you have lived apart outside the uk.

Each case must be judged on its merits, taking into account reasons for travel, length of absences and whether the applicant and sponsor travelled and lived together during the time spent outside the United Kingdom. These factors will need to be considered against the requirements of the Rules.

tnx joebloggs, that is what we were told by the HO, the only thing they might ask for is proof of my husband contract of employment and proof that we lived together on my husband time off.

So youre from scotland also, good to know that,, where did you take the test in Edinburgh so we have an idea where to book it.
Im going to take mine on October, wish me luck...

Im near the borders. Its in york place ( Pitman testing centre ) U can have a look in home office site on where to book the test near your place.
