Hi everyone,
I'm a Filipino. I'm currently working here in Malaysia as a teacher. I have a Hungarian boyfriend working in UK. He wants me to move there this coming August.
I've searched everything in the website he sent me, which is the Philippine Embassy in London. But still I'm confused.
I'll do appreciate if anyone can tell me or help me how to start with it. Right now, I'm only looking for a Visa application to UK. Not quite sure, how to start with it. and what Visa to apply. My boyfriend is working in UK for 3 years now and he would like me to gather all the information needed for me to get there. What would be the best approach or solution?
I hope to hear from all of you soon because I need to update him asap for the information.
Thank you so much.
Regards,
Chancy

Hi Ms. Leah,
Thank you for the quick reply. Yes, he visited me last January here in Malaysia. Right now, I'm confused with what type of VISA to get. Is there a way that before I arrive to UK, I can have a work permit? (unless I get an employer, right? ) Would that be possible? I am clueless with the processing and even though I've read websites about the visa application, I'm still confused.
What's your suggestion?
Thank you in advance again.
Cheers,
Chancy

Firstly, Welcome to the Forum.
If you will apply for a visitor visa you have to demonstrate to the Entry Clearance Officer
That your purpose is genuine, that you will LEAVE the United Kingdom at the end of your visit.
That you have or your sponsor have enough funds available for you during your stay in the United Kingdom.
That you have accommodation.
That you have met before.
That you have evidence of your relationship
Thanks for a warm welcome.
Thank you for answering my questions.
Now, knowing that this is gonna be the case for us, how long does it take for a visitor visa to be processed?
We are also looking at the possibility of applying for civil partnership? Have you encountered this one before?
Thank you in advance again.
Cheers,
Chancy

Hiya welcome aboard!
:Erm:Your BF will have to do some serious research on this. Visa for you shouldn't be a big problem provided that you fulfil the conditions given and supply all the documents needed plus some more:D. Here is couple of links to help you:
http://www.vfs-uk-ph.com/index.aspx
http://www.bia.homeoffice.gov.uk/eucitizens/
http://www.ukvisas.gov.uk/en/
http://www.ukvisas.gov.uk/en/ecg/
Next - your boyfriend as citizen of EEA member state (Hungary) has a right to bring you to UK if he is "present and settled" in UK for a year at least (he apparently is - 3 years in here now).
So you can apply either:
- for a fiancée entry visa - but you will have to pay for it the same fee as UK citizen has to (currently 42.120 PHP)
- or you can marry abroad then he can bring you in UK as a "family member of EEA national" - which is free of charge but you still need to apply at the UK Embassy for "Entry Clearance".
Just be aware that obtaining a visit visa might be sometimes very tricky and it is more like the lottery than anything else.
I'm sure that you can find lot of info on this forum, regarding fiancée visa and documents needed, but I'm not sure as what you need to provide for "Entry Clearance" - try to search the links above and try to ask again.
BTW - why not to tell your BF to join this forum too?:Erm: You can do this research together:xxgrinning--00xx3:
Hope I've been at least a bit helpful, take care and enjoy...:Hellooo:

Hi, I'm here again.
I would like to ask if someone here knows how to apply for family permit?
That would be the best solution that my boyfriend and I came up with. Since, he's a Hungarian, he can get me by applying for a family permit.
We are planning to have the wedding in the Philippines, secure all the documents and most probably I will file the visa here in Malaysia?
I would like to know also how long should I wait for the visa to be released and since the validity of family permit is 6 months, what should I do next? When I arrive to UK, can we directly apply for residence card. Can I still work there during those times? How long does it take to apply for it?
Thank you in advance....

Hi Mrs Major,
thank you for the advice. My boyfriend and I are planning to have our wedding in the Philippines this coming August since that's the only time we can do it because I am working and he's also busy working.
Do you know the requirements of Civil wedding in the Philippines?
Are you familiar with Family permit? We are planning to get that instead of spouse visa since he has the right to bring his family and we heard it's quite fast....
Penang is really far..I think ten hours. Penang is near Thailand while JB is very close to Singapore.
By the way, where are you staying in UK?

Requirement of civil wedding in the Pi-your Cenomar from NSO certificate of free to marry while your BF is certificate of no impediment (like wise prove of free to marry as well
you need to attend on the seminar for DSWD-if you dont feel to have one, just give under the table, lol
birth cert.both of you..
If youre married, you dont need family permit, straight ahead on appyling spouse visa, less hassle

I really need help with this one...
We couldn't decide which visa to get...we are torn between spouse visa and EEA family permit.
I called the British Embassy Manila this afternoon and i asked them about the difference between the two. The woman who answered me said spouse is for British nationals only while EEA family permit is for EEA citizens.
Am I getting the correct information? Please help!
It this the correct process for the following:
Spouse visa (3months to process) - ILR (2 years validity?) - Permanent Residence???? after 5 years?
EEA family (3months to apply) 6 months validity - extension - apply for residence card? I'm not sure whether this one is correct. Correct me if I'm wrong. - 5 years residency?
I'm really confused with the process....I've been gathering information about this for 3 weeks now...
Those who have gone through the EEA family permit....please help..
What do you recommend? Thank you so much again.

Yeah the answer you have been given is correct. In your case it would be better to marry abroad (Philippines or Thailand) and go for EEA family permit. There is a couple of advantages - no fee (as is on spousal or fiancee visa) and shorter processing times (take a look at this http://www.ukvisas.gov.uk/resources/en/docs/10368946/processingtimescustomers). As your boyfriend is citizen of Hungary, HE IS citizen of member country of EEA so you can apply under EEA family permit. Hope it is of help to you...

Hi,
Thank you so much for your reply... I really appreciate it. Yes, we are looking at the EEA family permit as of the moment. However, the validity of EEA is only until six months and needs to be extended. The process of extension is quite unclear to me. Would you happen to know the process?

Hi, sorry I'm replying bit late.:cwm3:
Just been looking at the pages of UKBA - the validity of permit you've mentioned doesn't seems right to me, because if you take a look at this link (http://www.ukba.homeoffice.gov.uk/eucitizens/rightsandresponsibilites/), they do not mention anything about validity. So I assume that your permit will be valid as long as you and your partner are permanently staying together in UK. May I ask where did you got that information?
Are you sure you didn't got it confused with some other kind of permit (visit visa or something)?
Good luck to you:xxgrinning--00xx3:

Hi there.....
Yes...I think I'm already confused by the process.
What's really puzzling me and my boyfriend is what's going to happen after family permit? I know I need to apply for residence card which will take another 6 or 12 months. Stated in the family permit that it's only valid for 6mos, so what's going to happen after the 6 months family permit that the embassy will issue to me?
I hope I can get answers soon.
By the way, we are already working out on our civil wedding here in Malaysia. We are both busy and it's really a problem for us. I can only have two weeks vacation and he can only have 1 week.
Much as I want to have it in the Philippines, I don't think it's still possible. So, we will have it on August. Hopefully, we can settle everything and proceed to the application of family permit. Our goal is for me to be there by the end of the year. I am really praying for that because I don't think I can still afford to be so far away from him.
According to the Consular here, the MC from here is valid there in the UK.
There are some unanswered questions that I am trying to get answers by calling the embassies. To be sure, I will go to the Consular and British Embassy this coming June to confirm everything.
I hope those who undergo the family permit process will enlighten us how to go through with it.
By the way, thank you so much for clarifying it. I appreciate that you put link to explain it further.
I hope to meet and see you soon...You're such a great help.
Cheers,

Hello Chancy, any progress in your app?
Hi there.....
Yes...I think I'm already confused by the process.
What's really puzzling me and my boyfriend is what's going to happen after family permit? I know I need to apply for residence card which will take another 6 or 12 months. Stated in the family permit that it's only valid for 6mos, so what's going to happen after the 6 months family permit that the embassy will issue to me? According to this (http://www.ukvisas.gov.uk/en/howtoapply/infs/inf18eeaswissnationals#Q27) you in fact DO NOT need a residence card but it is better to get one if you want to travel otherwise you will have to get EEA permit everytime you will be travelling abroad. So I will take it as the EEA permit DOESN'T have limited validity (6 months).BTW: For a residence card is possible to apply in person at their offices, then the application is processed and residency card issued the same day. But you need to phone them (not easy to get through the automated system and long waiting on line) and try to arrange for a personal visit/interview. For more info about rights and responsibilities of EEA citizens in UK take a look in here: (http://www.ukvisas.gov.uk/en/howtoapply/infs/inf18eeaswissnationals)
By the way, we are already working out on our civil wedding here in Malaysia. We are both busy and it's really a problem for us. I can only have two weeks vacation and he can only have 1 week. Not very sure about legal limitations for a wedding in Malaysia, but there might be a problem with your fiancees stay in there becuse it seems a bit short to me as many countries are imposing some limits for a marriage - for example in UK you have to be "settled" for at least one week before marriage can take a place, in RP it is even longer. But as i said - not sure about Malaysia.
Best regards... :xxgrinning--00xx3:

Nothing to worry about on that score.:xxgrinning--00xx3:
After a few months from arrival, you will have to send a small batch of documents to the Immigration office, including the husband passport.
The residence card is free of charge and valid for 5 years.
It will be a long wait, as ours was 6 months exactly to the day. But well worth it.

Thanks for asking. We are currently in the process of completing the documents needed for our marriage here in Malaysia. Our problem now is the processing time of our documents. We'll never know whether our documents will arrive on time (really hopeful). I'm just praying that it will.

Before you send your passport for a residence card, you can give yourself a couple of months to look for a suitable job.
The "Family Permit" sticker in the passport, states that you will be allowed to work, show that to any prospective employer and it will be ok.:xxgrinning--00xx3:
Even after your passport is sent to the Immigration service, you will be covered by their reply letter of receipt, as it will say that you are allowed to work or/and start a business.
After a while of being married, I would suggest you try to obtain also Hungarian nationality without giving up your own, as this will make it much easier to visit other Schengen area countries.
Next year my wife will be entitled to Italian dual nationality, which will be just a little more than a formality.

Hi aromulus,
Sorry for the delayed reply.
I've been very busy preparing the documents needed for our marriage here in Malaysia. We are going to have it this coming first week of August. After that, I'll apply for family permit.
We have some questions with registering marriage in the UK. Do we have to register our marriage in the UK? Do you know how to go about it?
Thank you so much!

As far as I am aware there is no need to register your marriage in the UK.
The only registrations that you are obliged to do, are in your own countries.
