THE Swedish nationals accused of operating a cybersex den in Cagayan de Oro are confined in a hospital for the last two nights instead of being detained in jail facility.

A police officer, who spoke on condition of anonymity, said Bo Stefan Sederholms and Emil Andreas Solemo are confined at the Madonna and Child Hospital since Sunday evening.

"They're not here (Maharlika detention cell) anymore. They were brought to Madonna for medical examination, and a doctor there recommended their confinement," the police officer told Sun.Star Monday.

However, a hospital staff refused to confirm the confinement of the two Swedish nationals, saying a policy bars them from providing such information.

Acting City Police Director Noel P. Armilla at first denied any knowledge of Sederholms and Andreas' confinement at Madonna, but later confirmed that the two were admitted to the hospital Sunday evening.

"One of the suspects complained of chest pain, so one of our officers took the initiative to have them brought to the hospital," Armilla told Sun.Star, explaining that he was only told of the suspects' hospitalization after he verified information coming from this paper.

It was not immediately clear, however, why both Sederholms and Solemo were taken to the hospital when only one of them had complained of "chest pain."

Nonetheless, a women's group who took custody of the several female "models" who were rescued from the cybersex den lambasted authorities on the Swedes' two-day admission at the hospital.

"This is another demonstration of our government authorities cozying up with foreign nationals who are abusing our very own women. The nature of this so-called hospital confinement is questionable," said Kristine Lim, chairwoman of Gabriela in Northern Mindanao.

The Swedes were detained at the Maharlika detention cell after the inquest at the City Prosecutor's Office on Friday.

For "humanitarian reasons," Lim said no one can begrudge the suspects' two-day confinement at the hospital "if only for valid health reasons."

However, the Gabriela chairwoman doubted the truthfulness of the Swedes' "medical alibi," saying it was more likely that the two were plucked out of the jail for "their own convenience."

Lim called on the police to return the suspects to jail, saying a two-day stay at Madonna can no longer be justified "for males who looked healthy and physically fit."

She said the police's treatment of the Swedes "can only be compared with how Daniel Smith was treated."

Smith, who was convicted and then acquitted of rape charges recently, has become a punching bag for women's groups denouncing the purported special privileges extended to aliens found abusing Filipinas-especially US servicemen.

Armilla said the Swedes are expected to go out of the hospital Tuesday and will be transferred to the Lumbia Jail.

"We are just waiting for the commitment order for them to be handed over to the Lumbia facility. They will not be expected to remain in the hospital when the order arrives today," he said. (JPN/DVAIII)

CAGAYAN de Oro City Mayor Constantino Jaraula ordered the local police Monday to launch an all-out drive against business establishments and Internet cafes posing as "prostitution" and "cybersex" dens in the city.

Jaraula issued the order after two Swedish nationals were arrested last week by joint police and National Bureau of Investigation (NBI) operatives for allegedly operating a cybersex den along the national highway in Barangay Kauswagan, this city.

Media reports claimed that at least 18 (a mix-up by authorities had earlier put the number to 17) female "models" were caught in a raid of a suspected cybersex den.

"We should not tolerate 'sabak-sabak' (prostitution) and 'hubo-hubo' (lewd shows) in our city," said Mayor Jaraula after he received reports of the proliferation of the illegal sex trade in the city.

Jaraula stressed that the city has so much to offer to guests and visitors, saying that sex trade would only erode the image of the Cagayanons as 'morally upright' people.

The local economy perked up after Cagayan de Oro City hosted several local and national conventions over the past few weeks.

"We should be able to offer to our guests and visitors something appreciable and admirable and let them bring home the lasting and wholesome memory such as good food, nice accommodations, and amenities and the like," the mayor said.

With the growing reputation of Cagayan de Oro City as a major investment and tourism destination in this part of the country, Mayor Jaraula noted that the city can compete with other fast-growing cities in the country, but not on the level of illegal sex trade, but that of on the level of "decency and morality." AT LEAST two policemen have been investigated in connection with the hospital “confinement” of two foreigners accused of operating a cyber sex den in Cagayan de Oro.

Acting City Police Director Noel P. Armilla said Tuesday that the two policemen were responsible for bringing the Swedish nationals -- Bo Stefan Sederholms and Emil Andreas Solemo -- at the Madonna and Child Hospital in Barangay Carmen last Sunday evening.

Prosecutor Fidel Macauyag, in an interview with Bombo Radyo Tuesday, said his office was not aware of the Swedes’ confinement in the hospital.

Macauyag warned the policemen who brought the suspects to hospital may face charges for not following proper procedures.

Although he did not release their names, Armilla said that initial investigation revealed that the police officers were anxious that they may face charges had they decided to decline the request of the Swedes, who had sought medical attention.

“The policemen appeared to be acting on a judgment call, and they had to act, fearing that they may be charged by the suspects’ lawyer,” the police official told Sun.Star Cagayan de Oro.

Armilla said Sederholms and Solemo’s lawyer, Quin Babarin, was the one who talked to the police officers on bringing his clients -- who were then inside the Maharlika detention cell -- to the hospital.

Although Armilla admitted that the proper procedure would have been to ask permission from the City Prosecutor’s Office, he said this wasn’t possible on a Sunday.

Armilla earlier said that one of the Swedes had complained of “chest pain,” but it remains unclear why the two of them were transported to the hospital.

He said the Swedes were to be discharged from the hospital Tuesday, but it would depend on the doctors whether or not to release them.

The police official also assailed “reports” of bribery.

“There is always this presumption of irregularities sa side sa polis ug kon dunay nakasapi ani walay lain kon dili ang doctor ug ang hospital nga gidalhan sa ila ug dili ang polis,” Armilla said.

Gabriela demands probe vs cops

By Annabelle L. Ricalde

* Both Swedish nationals diagnosed with acute gastroenteritis with mild dehydration, others, and are likely to remain 3 to 5 days in the hospital, police official says

* Police could have called on government doctors when suspects complained of health problems, Gabriela says

* Police officials appeared to have issued conflicting statements surrounding Swedes' hospital confinement

MILITANTS will stage a picket during Thursday’s preliminary investigation of the two Swedish nationals accused of operating a cybersex den in Cagayan de Oro.

Gabriela, a militant group advocating for women’s rights, also call on authorities to investigate the local police for the alleged “special treatment” given to the foreigners.

Gabriela said local officials should launch a probe on the Swedes’ “confinement” at a local hospital, as police appeared to have issued confusing accounts on how the suspects were allowed to go out of their cell.

Police Chief Inspector Aaron Mandia, chief of City Mobile Group (CMG), the unit in charge of guarding Bo Stefan Sederholms and Emil Andreas Solemo, said the suspects are confined at Cagayan University Medical Center (CUMC).

But acting City Police Director Noel P. Armilla said Sederholms and Solemo are confined at the Madonna and Child Hospital. A police officer at the Maharlika Headquarters also told Sun.Star the Swedes were brought to Madonna for a medical check-up.

Mandia said police brought the Swedes to Madonna last Sunday evening, but were refused admission because the hospital could only accommodate children.

Armilla also said Monday that Sederholms and Solemo were to be released Tuesday, and were expected to be committed to the bigger Lumbia City Jail.

However, Mandia said the suspects will remain at CUMC for the next three to five days upon the recommendation of their physician, Dr. Ramon F. Moreno.

Solemo and Sederholms were both diagnosed with acute gastroenteritis with mild dehydration; borderline hypertension and hypokalemia, secondary to acute gastroenteritis, the police official said, citing the Swedes’ medical certificates.

"Pareho yata ng sakit ang dalawa. Ang pinagkaiba lang ay yung kay Sederholms with dehydration talaga, compare with Solemo na mild lang ang dehydration," Mandia told Sun.Star Cagayan de Oro.

Mandia’s statement contradicted Armilla’s account of the suspects’ reason of confinement saying only one of the two suspects had complained of “chest pain”.

Police had no explanation why the two were brought to the hospital when only one of them had complained of “chest pain”, a condition that differs from Solemo and Sederholms’ latest diagnoses.

Armilla, who claimed he had no knowledge of the Swedes’ hospital confinement, said the police officers, had only acted based on “judgment call.”

Kristine Lim, Gabriela regional coordinator, said “nobody was impressed” with the police’s conflicting statements surrounding the Swedes’ hospitalization.

“There are reasons to doubt of these health claims, first being the process in which they were let out of their cells like thieves in the night,” Lim said.

Lim said the proper procedures would have been to ask permission from the court, or the government prosecutors—even on an informal basis.

If the permission from proper authorities was not immediately possible, she said the police could have contacted government physicians to attend to the health conditions of the suspects.

“But the police chose to throw the rules and by doing so, have manifested their partiality toward the suspects,” she said. “Anyone in his or her right mind could say that the police gave the foreigners especial treatment.”

Lim, whose group is taking custody of at least eight female “models” allegedly employed by Sederholms and Solemo’s cybersex operations, said the local police “will remain in the negative spotlight as long as the suspects are enjoying the cozy amenities of the hospital rather than being in jail.”

Mandia said the two are likely to remain in the hospital, pending the commitment order from the City Prosecutors Office.

Sederholms and Solemo were arrested late last week following a raid on a suspected cybersex den located along a busy national highway.

Along with four others, they were charged by the National Bureau of Investigation with trafficking in persons, a non-bailable offense.

Mandia said police were also unsure whether to bring the suspects to the Hall of Justice for Thursday’s preliminary investigation, saying the Swedes’ health conditions may also be considered in the decision to discharge them from the hospital.
