Hi all,
Went to see an immigration lawyer,came out 45 mins later and £175 poorer lol :bigcry: Anyway the story is my girlfriend from the philippines was abandoned by her husband three years ago and he will not play ball for an annulment,hence the visit to a lawyer,who told me dont worry go for a legal separation then we can apply to the secretary of state for a visa for her to come to the UK under "Extenuating Circumstances" Just wonder if any of you guys have heard of this,because its a new one on me.Look forward to any replies,thanks John.

The immigration lawyer should clearly explain to you what is 'Extenuating Circumstances"..
in case, if your girlfriend will be granted a visa to enter UK under that "Extenuating Circumstances".....and if you plan to get married in the future...i guess she will still have to sort out all those 'legal separation' or annulment procedures....

I have had the same problem with my girl friends ex husband, and wha we did was advertise in the newspaper that she intendeds to apply for an annulment in the courts. You have to put this advert in for three weeks and if he does not reply. You can apply for the annulment.
But a will tell you i have been doing this for the past year, and we are still only at the second hearing stage, to get an annulment in the Philippines is hard work and costs about 200,000.00 pesos by the time you are finished.

"Extenuating Circumstances" is a legal term for exceptional circumstances ( a laymans term )
i heard of that before but i think its so difficult to prove.

some opt for "presumptive death" for an easier, cheaper way out but i think thats an absurd idea.
means the ex husband really have a death certificate! lol

Thanks God!!! my plan to marry my ex-partner before did not push through....annulment is a very expensive issue, will cause a lot of headaches...
anyway, while i was in the seminar for the CFO, the person who conducted the seminar had mentioned that you may already file for an annulment for more than Php 10,000 only...it's so cheap we can't believe it.....i doubt anyway...but who knows...

has this been resolved? anyway i actually got annulled last year (filed it even before i met my current fiancee) and my ex husband didnt really appear on court at all. so basically we really didnt get anything for him.. my lawyer said it is actually much better so we can bring up everything without the other party contesting it.. hence the whole proceeding was actually quicker and easier... let me know if you have any questions maybe i can refer you to my lawyer..

And why the rest of you filipino's are here why hasn't anyone suggested the obvious. Jonnijon if you are, or your wife is still in cintact with the ex husband, which i presume you are, then surely the quickest way to sort the problem out will be to 'buy' your wife off him. Just offer him a grand and he will probably be a little more willing.

This is new... If she will file for a legal separation then can she get a "Certificate of No Impediment" from the National Statistics Office? which is a requirement inorder to get married?... Who issue this "Extenuating Circumstances" paper the UK or the Philippines? Thanks....

That is very cheap!!! P10,000.00 where is this and who is the lawyer? Do you think this will be through by 1 yr? I wish to meet the lawyer....The cheapest i have heard is P50K....

Yes that is cheap cuz that could only be the filling fee... acceptance fee is not yet included... its all depends on your agreement if its package that is way far from reality... but if its per hearing thats... :xxgrinning--00xx3: acceptance fee is arond P20,000 depending on the lawyer....

Hi Ady,dont bother with it mate,go for anullment.My costs so far are as follows.Lawyer,all crooks:icon_lol:75,000 peso down payment,55,000 on completion,25,000 for the shrink and 10,000 for unseen costs.So this will give you some idea how deep your pockets need to be,and the way the exchange rate is going they will have to be very deep:NoNo:We only filed this month and things are flying ahead,so fingers crossed:BouncyHappy:

Hi Andypaul,at least I wont be paying the UK government any crazy visa fees,or taxes we will be living in Phills.I have chickens,ducks,goats a small house,a good woman,two banana trees 3 meters apart,my hammock fits perfectly between them lol lol,goodbye to the 16-18 hour working days.
