I think when the marriage is not annulled yet then it means your status (legally) is Married it is only through the courts our status can be changed
I have used my maiden name because my ex partner was actually a married man when he married me as soon as I am aware that he was married I requested a CENOMAR and filed the case and started using my maiden name because my ex partner's wife can take me to court if I carry on using my ex partner's surname knowing that I am not legally allowed to.
I am not sure if you will need marriage cert or annullment papers for a tourist visa on the other hand that is also one good reason to say look I'm coming back for sure coz of this court proceedings ..
birth certificate yes to that. Goodluck to your application.
