working visa entry clearance refusal

hi...my brother and his co-nurses were sponsored by an NHS hospital. They filed for visa at the UK VFS 2weeks ago and just 2 days ago, 34 of them were refused entry because they only got 65points and not 70 which is required. Their agency told them that the reason why they fell short of 5 points was that they did not graduate from a school which is a center of excellence... Does school matter? We know that once a person has bachelor's or master's degree, 10 points is given. Now, the agency will appeal. Do you think my brother and his fellow-nurses be granted visa? How long will it take?thanks

The school very much matters, and 10 points is not always given for a qualification. Sounds like the agency made a mistake by not checking the points for each of the applicants, otherwise they would have known in advance. There is a very good chance that their appeal will be rejected as the reason for rejection is valid.

Does the UK Border Agency published an official list of Schools which are the Center of Excellence? How would you know if your school is part of it?

Never seen a list, but if you go to the working in the UK part of the BIA website and use the online calculator you can see how many points a qualification awarded by an educational body will receive.

:bigcry: It DOES seem hard-lines that your brother and his nursing colleagues were *denied work permits on the strength of such a *narrow margin. However, Welcome to the forum.

Unfortunately, in the light of the replies you've received from someone with specialist knowlege at his fingertips, it looks as though the prospects of winning an appeal against this decision are, at best, rather bleak ... for the time being. at least!

:Erm: If it's any consolation, my wife [who taught for twenty-two years in the Phils] is prevented from pursuing a teaching career in Scotland ... simply because her BSc + part-Master's degree is not deemed to be of a standard equivalent to that required here. :censored: barmy, I know ... but there you go!

That though is the point of the points based system. You either score enough points or you don't, there should be no confusion.
