i am filipina married a filipino he leave me for 6 yrs and i only support my children alone until my eldiest work and then helped me together until i meet my fiancee from ireland we been in relationshiop for 5 yrs and i would love to move in ireland. In what way i can do to get a visa and i would love to bring my 4 kids with me please help me about this problem and explain me what i need to do thank you very much

:Hellooo: Welcome, Myrna ... :Erm: I feel as if I'm greeting my wife here, as that's HER name, too!! :lol2: We married last December 8 in her home town of Tagum City, Davao del Norte' Province, Mindanao. She came to Scotland exactly 3 months later [March 8] on a spousal visa.

Since your fiancee is from Ireland, the visa process *differs to some extent from that applicable to the UK :rolleyes: ... in which case, I would prefer if someone else on the forum - someone more knowledgeable about such *variations than myself - were to advise you ... especially a member conversant with the procedure(s) involved in applying for family settlement.

Welcome to the forum. The first thing you need to do is get your first marriage annulled. The only other option is if you husband no longer around, you don't know where he is and you haven't heard from him or his whereabouts for at least four years, you can file for "Presumptive Death for the Purposes of Remarriage". Until you do either of these two things, I don't think it will be possible for you to get a visa to go to Ireland.

if ur annulment done,then u can get married if u marry to philippines, then apply for spouse visa,if your planning to marry in ireland,thats what we call fiancee visa,and u need to gather all the necessary docs,what are the docs? search here

The only visa you could apply for at this moment in time is a visit (tourist) visa, but it is very unlikly that you would be given one. They usually refuse on the ground that you would be unlikely to return to the Philippines before your visa expires. They usually decide this on the basis of whether you have enough good reasons to return to the Philippines and to them that means whether you have well paid regular employment there, money in the bank there and property there. If you don't have these things then it's likely that they would refuse a visa.

Once your annulment process is complete you have 2 options with regard to visas, fiancee or spouse. More people tend to prefer the spouse visa because it means you don't have to apply for any more visas for 2 years and also because marrying in the Philippines is much cheaper than in the UK.

If you apply for a fiancee visa you have to get married in the UK within the six month period of the visa and then you have to apply for an extension for your visa which is called FLR (Further Leave to Remain) which means you then have 2 years in total which includes the six month period of the original visa before you have to apply for ILR (Indefinate Leave to Remain).

It is also thought that a spouse visa application (provided the application form is filled in correctly and all of the necessary evidence and documents are included) is less likely to be refused than a fiancee visa application.
