We applied for a fiancee visa in June 2010 which was was denied in July 2010. The reason given for refusal was that our relationship was not deemed to be a subsisting one even though we had been seeing each other for more than three months. Since we lodged an appeal in August 2010 the circumstances of my fiancee have changed and she can no longer be a residenrt of the country in which she applied and must instead return to the Philippines. For this reason we are now about to make a fresh fiancee visa application. Does anyone know how long this process will take including the English test. Also does anyone know if my fiancee should abandon her appeal as the date of the tribunal is April 4th 2011 but she will no longer be residing in the country in which she applied where she worked as a caregiver. In other words if aan appellant changes his or her circumstances by no longer residing in the country where the appeal was lodged can he or she continue with the appeal?
