Hi! everyone!I am wondering If working and tax credits may affect my wife's settlement visa application?I tried to enquire here and they said that as long as it is in under my name and its not a joint account its alright.Im quite confuse though...Is there anyone who experience the same situation as mine?I hope you can give me some ideas regarding this matter. My wife and daughter are going to apply visa soon.Thank you for any help you can give me would be greatly appreciated.God Bless all!:)

When i applied for my wife and her daughters settlement visas i was already claiming tax credits. They are now with me here in the UK. As i remember though its VERY important you declare that you are claiming them on the application. There is no reason why you houldnt claim. Your wife will (hopefully) be given a visa that says 'No recourse to public funds' but this doesn't stop you claiming your tax credits. I am still claiming them now.

Quiet right. Tax credits were introduced in 2003, and the immigration rules were subsequently modified in 2005. The rule change in 2005 affects couples where one partner is not subject to immigration control (i.e., a British citizen or permanent resident); and the areas the rule addresses are [1] working tax credits and [2] child tax credits. Under the rule, a couple may claim these tax credits without jeopardizing the immigration status of the person subject to immigration control.
Simply put, a married (unmarried, civil partnership) couple can claim child tax credits and/or working tax credits as long as one partner is a British citizen or otherwise exempt from immigration control.
