Hi,

I'am just trying to work out when we need to apply for my mahals ILR. The 2 year qualifying period, is that from when she arrived in the UK (fiancee visa) or when her FLR started?.....

She arrived here Nov 2010, and got her FLR April 2011. So do we apply Oct 2012 or March 2013?......thanks very much for your clarification.:

2 years from the day she arrived i think, thats how we are going to do it

From the UKBA website http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/applicationtypes/applicationformset%28m%29/

If we gave you permission to remain in the UK as an unmarried or same-sex partner and are now applying to settle here as the husband, wife or civil partner of the same person, your 2-year qualifying period started on whichever is the later of these two dates:


the date when we gave you permission to remain as an unmarried or same-sex partner; or
the date when you arrived in the UK.

It looks like when you applied for FLR, that is when your permission to remain was granted and therefore the two year period starts then.


When you applied FLR, did they put a visa in your passport, if so, when is that visa valid till?

It's from the time she was granted FLR visa.
You can apply 28 days before expiry of the probation period (ie 28 days before the 24 months anniversary of getting FLR ). I would recommend doing that just to gain a little extra breathing space.

BTW when applying for Naturalisation you can actually include the time spent in UK under Fiancee visa. Yep it's complicated.
