Hi everyone.:Wave:

I'm Marga,a newbie in this forum and happily married to a brit.

I would like to seek some advice regarding my hubby's IVA (individual voluntary arrangement).My question is,can we still apply for a spouse visa even if he has that iva?

I doubt they'll do a credit check, but he will have to show that he has sufficient disposable income (meaning after paying all commitments like rent) to support you both without resort to public funds (welfare).

you need to beware, that he needs really, to show a minimum weekly amount remaining after paying rent or mortgage, council tax and any *loan/credit repayments for a couple is £105.95. You don't need to include other bills and outgoings.
but You will need to include the *IVA payments in your calculations.

I don't think he needs to give exact details of each of his payments, but bank statements (in credit) will need to be shown.

Why doesn't he ask the UKBA for advice before completing the forms ?

Marga, :sorry-2: ... short of being privy to the nature and extent of your husband's 'individual voluntary arrangement', :rolleyes: it is difficult to guage its inroads on his overall financial situation.

However, it would be reasonable to assume that, so long as his bank statements clearly indicate you can live comfortably as a couple - after deduction of normal everyday household expenditure, and without any likelihood of becoming reliant on public funds - then everything else should fit into place. ;)

Well I wouldn't.

It's irrelevant as long as he can satisfy the normal financial requirements.

He's not applying for a credit card. :rolleyes:

IVA does,nt show up on bank statements as i,m led to believe but does show up on his wage slips so it will be spotted on visa application but only if they ask for pay slips.now IVA is a percentage type agreement to more you earn the more you pay so there is no incentive to work overtime .for a fixed period of 5 years then all debt is cleared my friend is half way through his and he said it hurts like hell it leaves him very little to live on so i think it could affect your application to a degree because you will be an added expense to his out goings .but i,m hoping that they will give you the visa but just be prepared in case they refuse i hate to here anyone getting turned down for visa so good luck and keep us in touch of the outcome.

Experian is already working with HM Revenue and Customs to confirm the identity of applicants for tax credits. It says that "early indications suggest it is creating a serious stumbling block for both professional and opportunistic fraud attempts".

I know the Tax credits people do, they asked me about a loan i had for ID purposes :yikes:

In the end it still boils down to how much money the sponsor has to support himself and his partner. :rolleyes:

The rest is a red herring and totally irrelevant IMO.


I don't know why some people seem to want to make it harder for themselves.

Maybe that's why they got into such debt in the first place. :NoNo:

Just my 2 centavos

As it stands right now the UKBA will want to see at least Income Support levels.
That means a minimum of £111.45 per week of disposable income. After payments for rent/mortgage/loans and iva etc
Means completely free to spend on whatever.

Maybe the IVA payments do not allow that much "free income" each week.

Without the required income UKBA will have great difficulty to grant the visa.

Looking out to the future, the UKBA may introduce financial thresholds based on gross income only. In which case you may stand a better chance.

hi guys, hope everyone had a great jubilee weekend !! :) i would like to ask if anyone would know how much savings would be required to show as proof of fund..????:Erm: i work full time as a healthcare assistant and earn only a modest wage, i have good savings and never overdawn, dont have credit card or overdraft, im in no debts, i currently live with my sister and only pay a small amount of rent, she has also agreed that maria can use her address for visa application, her house is her own and is paying her mortgage. could anyone give me help or advice, would greatly appreciate it, thanks guys.:xxgrinning--00xx3:

also maria is in the process of getting new passport, id's changed etc.. she will book her ielts exam soon, so we will be starting the visa process soon, in the next couple of months, she is currently in employment working as a computer tech for accenture, she has years off experience of working as computer professional and will also show her own proof of funds and also her own family will support her with funds also.. i hope this also will be an added plus for our application :)

UKBA does not state an exact savings amount requirement. What is important is you can prove that you can support her- for the visa application, flights, etc.

Also the Evidence of Maintenance requires that you show at least 6 months of bank statements- to show consistency of income that is enough for both of you, without recourse to public funds.

If you will be living with your sister, have her write a letter to the UKBA confirming that you live with her and permitting Maria to live with you. You need a copy of her mortgage papers (notarized if original is not available), utility bills and photos of the property.

1) What is the amount we need to show we have available in funds? Is it £111.00 as a couple or £105 per week?

2) I didnt include what I spent my money on per week as I live with my parents and dont have to pay rent as will be the same situation with my fiance and I when we live here. Is that OK? I didnt say how much I spent on my groceries etc as I didnt think they needed to know that, I just thought how much I had left over after rent was all I had to show. I just said I receive Contribution based ESA at £105 per week and I am not required to pay any rent and I just use my money for things like groceries etc but I didn't say how much of my £105 I spend on toiletries and food? Is that OK?

Ahh OK, so basically its ok that I didn't include groceries, the only thing the UKBA are bothered about is rent, rent/mortgage/loans and iva etc and it was OK I didn't include what I spent and how much I spent on shopping?

I really really would love to know if BriaNoreen had 3rd party support though?? does anyone know? as that would give me so much hope as I didn't have 3rd party support either.
