they should play by the rules just like all of us, they must have known if you go out of the country for 2 years or more and you could lose your ILR, they left for 5yrs, they should have stayed another year/or applied for British citizenship b4 they left. they didn't its their loss and as harsh as it is, they should go back to OZ and apply for a settlement visa again. and why apply for a visit visa ?? and then decide to stay :NoNo:why not a settlement visa? :NoNo: its thier own fault they will be apart for taking the :piss2:

i think he did know better, that's why they applied for a visit visa, valid for 6 months but you get back in the UK, :NoNo: one of the reasons why visit visa for spouses are difficult to get :NoNo:

Rules are rules no exceptions should be made for these people the woman should have done what untold Aussies/Brits do and got joint citizenship. Not an ounce of sympathy from me

nor me dedworth, I'm sure they knew the rules, why would you apply for a visit visa then and not just try and come back to the UK? because they found out they wouldn't get back in the UK. they be sent back on the next plane.

There was a case on here some time ago. I think it was raised by Fred.
Similar circumstances but an elderly couple. Can't recall the detail (or find the thread)
The Home Office applied the rules strictly then also.

my stepson got warned by immigration at Manchester airport when he came back to the UK they marked his passport, he was 2yrs and 1 day out of the UK, he was told if it happend again they refuse him entry :doh , he got his dates wrong so when he landed he was 1 day over.. but this couple are 3yrs over :doh
