We want to apply for an unmarried partner visa in September.

I am a sponsor returning to the UK, as we both live in Bangkok.

Do I have to have, as I understand ANNEX B to state:

1. A firm job offer to commence work within 3 months

AND

2. Salaried income for the 6 months prior to POA being equal to or greater than 18,600 GBP per annum gross.

or just number 1.?

as the update also states:


4. Permitted sources for meeting the financial requirement

Income from employment or self-employment of the partner and/or the applicant if or
once they are in the UK with permission to work. (This means that the applicant’s
earnings from employment or self-employment are excluded at the entry clearance
stage. There is also scope for the applicant’s partner, if they have been working
overseas, to count the income from a confirmed job offer in the UK).

My monthly income is always different as I am not on salary but get paid hourly. It comes to more than 18,600 per annum though.

Will evidence of this be sufficient if I need to meet 1. and 2.?

Hi Ritfor,

In your case you need to meet both the requirements you mention.

1. Yes, you will need to meet the new financial requirements.
That is, a minimum gross annual income of £18,600 (or the relevant higher figure where a child or children are also being sponsored).

2. Yes, UKBA will have the scope to accept a firm, verifiable job offer or signed contract of employment to start work within three months of your UK return date, provided it's at the salary level required to meet the specific financial requirement.
You must also demonstrate that either you are in employment overseas at the required salary level at the point of application, and have been so continuously for at least the previous six months,
OR
that you have earned the required amount through salaried employment in the 12 months prior to the application.

I understand "salaried" to be 12 x the same amount every month for one year.

I get paid hourly so I get a different amount every month. It comes to more than 18,600 per annum though. Well actually, 9,300 for six months.

Is this type of paid employment OK?

As long as it's your evidenced gross income that meets the requirement it will be counted as earnings from salaried employment.
The same applies to overtime, commission-based pay and bonuses, all will be counted as earnings from salaried employment.

It's just a case of submitted sufficient documentary evidence.
