View Full Version : Fiance Visa and The Financial Requirements. Can You Help?

Hello There.

I'm hoping someone could enlighten me on a few queries I have about fiance visas to the UK from the Philippines.

I've been doing some research on the UK Border Agency website about this and there's some things that aren't particularly clear for my case.

I will paste the specific paragraph's below and then run through my stumbling blocks.

Paragraph 290

(iv) adequate maintenance and accommodation without recourse to public funds will be available for the applicant until the date of the marriage or civil partnership; and

(v) there will, after the marriage or civil partnership, be adequate accommodation for the parties and any dependants without recourse to public funds in accommodation which they own or occupy exclusively; and

(vi) the parties will be able after the marriage or civil partnership to maintain themselves and any dependants adequately without recourse to public funds;

Paragraph 56

(i) meets the requirements set out in paragraph 41 (i) - (ix) and (xi) - (xii)

Paragraph 41

(i) is genuinely seeking entry as a general visitor for a limited period as stated by him, not exceeding 6 months or not exceeding 12 months in the case of a person seeking entry to accompany an academic visitor, provided in the latter case the visitor accompanying the academic visitor has entry clearance

(ix) does not intend to do any of the activities provided for in paragraphs 46G (iii), 46M (iii) or 46S (iii)

(xi) does not intend to receive private medical treatment during his visit

(xii) is not in transit to a country outside the common travel area.


So, my questions are:

1) How much funds is suitably 'adequate'?

and...

2) Can the fiance work at home under this visa, for example, working an online job?

Hopefully it will help your overall basic understanding.

Concerning the specific questions you raised:-

1. The 'Partner' visa's leading to settlement in the UK ALL require the sponsor to comply with the relevant income threshold.
The link I posted above will help you with this, but in principle the minimum income is based on an annual gross earned income of £18600

You only need to be informed about the meaning of adequate income IF you are exempt from the Financial Requirement.

Read the thread I give and follow all the links. Ask any specific questions you may have.

2. The Fiance(e) visit is a 6 month duration visa issued solely for the purpose of marriage in UK. There are a lot of visa conditions and restrictions.
The major restriction of the holder of a Finace(e) visa is that of being prohibited from any form of work (paid or unpaid) or that of participating in any kind of
business activity (paid or unpaid) or in any kind of voluntary activity/placement.

This can become a major issue. However to minimise the restrictions, once the marriage have taken place the the FLR(M) Further Leave to Remain spouse
visa may be applied for in person at a UKBA enquiry office (by appointment) if you are able to pay the additional premium fee.
Without doing this the waiting time for FLR can be quite a long time (8-10 months possible)
