As long as your husband is willing to support your papers NOW, why would there be a problem ?
If you don't apply (correctly and on time), then you WILL have problems.
What is there to lose ? Go for it.
It seems to be taking them months to process it now anyway, but as long as your papers have been sent to them by the due date (special delivery)...:anerikke:

Complete the ILR application totally honestly and submit together with the signed declaration (section 13) from you and your husband.
It's up to you if you will include any additional explanations in a covering letter.
Nothing else you can do really.
There may be some questions, but as long as you're honest it's OK
How long were you living apart?
I think you need to state this on the application form anyway.
Without submission of the ILR application and your husbands signed declaration you will be putting yourself in a vulnerable postion as illegal immigrant.
If your husband will not sign then you may consider the domestic abuse route for discretionary leave. But that's another story.

only few months, im just worried they refuse my applications coz of that problem. and they might ask a lot of question where i stay and so on and so for, do u think its best if i get solicitor?

I don't think I would waste money on a Solicitor yet (most of whom are a waste of space when dealing with such matters anyway).
As others have pointed out, you can get free legal/immigration advice from Citizens Advice Bureau and other agencies.
Submit your application, making it simple and straightforward, without going into long expanations of matters which they haven't even asked you about (yet).

Be careful what you put in the supporting letter.
Just make it easy for them to say yes (without telling untruths).
They are very busy clerks in an office, with a giant stack of forms, simply wanting to tick boxes and then go home.
