Good Day Everyone!
I arrived here last August 15 2012 and my spouse visa will be expiring November 14 this year. What date will be the best to apply for ILR? I know that i need to process before 28 days before my visa expired. (just bit confuse).
My Second concerned is about my English Test. I took my test in Hopkins and my scores equivalent to B1. I read that TOEIC (ets)( https://www.gov.uk/government/publications/guidance-on-applying-for-uk-visa-approved-english-language-tests ) is no longer licensed by the Home Office. Is there testing centre near London I can take my English test?
Hope I can hear feedback. God bless.
Cheers,
Alma

Are you under new rules or old rules? When did you applied for your spousal visa? Is it before or after July 2012?

I presume as you arrived 15/8/12 you would be under old rules taking into account the time frame for visa applications was averaging 8 weeks at that time so correct me if I'm wrong your application was put in prior to July 9th 2012.
If that's the case then you would eligible for ILR after 2 years living in the UK and would need to make that application before the 2 year deadline of 15/8/14 so correctly up to 28 days prior to that is fine.
With regards to the English Test, B1 level is acceptable for ILR but with regards to Hopkins others here will clarify...:xxgrinning--00xx3:

Thanks for the quick response, I applied my spouse visa in the Philippines July 10 2012. Am I still eligible to applied before 15/8/14 even I traveled 31 days (holidays) outside UK?
With regards to English Test, I booked myself on July 25.
Cheers xx

Good Day!
Thank you for the quick response in my previous post.
Still confused!
Way back the time I applied my spouse visa. I applied thru online application dated July 3, 2012 and my appointment in VFS Global Makati was July 10, 2012. As I scanned my emails I got my UK entry clearance July 16, 2012. Am i still on the ' Old Rule'? The Valid date to travel was August 14 and I arrived UK the following day. My Visa will be expiry Nov 14, 2014.
God bless

As you applied after 8 July 2012 then you will be under the new rules or 5 year settlement route that means 30 months initial entry clearance then followed by a further 30 months or whats called FLR then finally you can apply for ILR so basically an option for ILR at this time is not possible.
Going from your arrival in UK on 15/8/12 then a further extension or FLR will needed to be put in no more than 28 days before 15/2/15.
Hope this clarifies things and I am sure our other members will also point you in the right direction.
Good Luck.....:xxgrinning--00xx3:

You're under the Old Rules as you have a 27 month visa instead of the initial new rule 30 or 33 month visa
You arrived in the UK on the 15th Aug 2012
The earliest you can apply for ILR is after 2yrs of being in the UK - up to 28 days
That date is 15th Aug 2012 + 2yrs is 15th Aug 2014 - 28 days
which is 18th of July 2014
The latest a few days before your visa expires on the 14th Nov 2014
But it's always best to apply for a visa asap as it gives you more time to sort out any problems should they arise

It does help if you're given the correct date first time
KeithW: If your visa is valid for 27 months you're under the Old Rules
If its 33 months you're new rules
