Patrick, as far as I understand, if her British spouse died while she was still under immigration control, then she can apply for ILR immediately not FLR.
Am sure others will clarify this...:smile:

Our friend did not pass the life in the uk test and her current visa expires 28th of this month so I booked her peo appointment at Birmingham for her FLR

Which form have you been using? She should not be applying for FLR(M), but settlement as Mark has already posted.. it should be SET(O). Read the links below ..
I think she's exempt from the Knowledge of Language and Life in the UK tests as a widow.
Section 4 - Knowledge of language and life in the UK
You are not required to complete this section if you are applying in one of the following
categories:
•
Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial Review Policy
Document,
•
highly skilled migrant under the terms of the HSMP ILR judicial review policy document or
•
bereaved partner.
If you are applying in one of these categories, go to section 5.

Oh my God, I booked this PEO appointment. It's paid already. Can I log on to the PEO site to change and make the extra payment without my friend losing her money?
Will I be able to change from FLR(M) to SET(O)?

Not sure, as I've never used it, but the info is here, give them a call and double-check what I've posted, before you change or cancel the appointment.

I phoned them and they say if she goes to the PEO appointment and takes the original summary sheet and the SET(O) form then she can just pay the additional fee at the appointment

That's a bit of an increase, nearly £600 more. :NoNo:

Forgot to mention, I know why some people on Tier 1 and HSMP visas are not required to take these 2 tests, they took the gov to court and won, stating that these changes were unfair and the judge decided that they were :wink:
And for bereaved partners, as you no longer have a sponsor, your application will now be considered 'outside' of the standard immigration rules, so FLR(M) is not used.
