My wife wants to go back to the phils for a short visit to her family.

The trouble is that at the end to this year she has to reply for the second stage of her visa.

I have told her that she cannot go back now because this is the year she needs to get that 10 year visa and that she has to stay throughout this year until she has got it first.

Am I correct about this?

If it's just a short visit, then I don't see any problem with it. There's really no residential requirements for ILR, only in British Citizenship. She's allowed to have holidays overseas. Is she getting an ILR at the end of the year? As long as it's not more than 180 days (or 6 months), I'm sure it's fine.
