    What UK visa for Ruby?

As I understand it, a UK 'spouse visa' is intended for someone who intends to reside in the UK. What visa options are open to Ruby (married to a Brit, but intending to continue residing in Phils). The reason for wanting a visa is that it is quite possible that we will wish (or need) to make temporary visits to the UK from time to time. Is the only option a long term (10 year?) visitor's visa, or is there another possibility?

What I would really like is to obtain a UK passport for Ruby (is this possible?), otherwise we will always be joining different queues at the immigration desks (our children coming with me).

A UK passport isn't possible unless you are willing to make the UK your main home for at least 3 years.

I think you are right I take it you are now not resident in the UK

If that were to change in the future you would probably already qualify for a settlement visa

She would be a visitor on trips to the UK and with joint property/savings in the Fills she should easily qualify

Is there such a thing? If so I guess that's what you'll need to get. Otherwise you'd have to apply for six month visit visa every time you wish to bring her the UK and that would be not only time consuming, but very expensive.

    Iain.
You can request a 10 year visitor visa (question 6.11 of VAF1) though it's up to the ECO whether they will actually issue you a visa for that length of time.

How about if Ruby applies for British citizenship (I think it's automatic if married to a Brit, right?) and apply also for a dual citizenship with Phil embassy. That way she can stay in the Phils for as long as she likes and can also stay in the UK.

If only that was true. Being married to a Brit doesn't even give you the automatic right to a visa to get into the UK.

There's no such thing as automatic! If only that easy, but I'm afraid it's not. We (as a spouse, married to a brit) have to stay here for 1 year to be a residence (that's during my time and now 2 years) then 3 years to become a citizen of this country.

It's not possible to a filipina to get a UK passport without staying in this country for a certain length of time. Why not stay here in the UK for 2 years and let Ruby get her ILR in that case she can then in and out in the UK without a problem.

Yes, as I feared ... a visitor's visa is the only option - I hope that we'd be successful in applying for a 10 year visa.

For those who suggest living in UK for a while ... I've already sold everything I ever owned in UK (or brought it with me) so there is little to go back for. In addition, we now have commitments here, running the farm etc, and wouldn't want to be absent for a long period.

Perhaps things will be easier if the Treaty of Lisbon is fully ratified and adopted ... but perhaps not - UK has already secured an exemption from the CFR. :(

she would be taking a risk doing that with ILR, your suppose to be a resident of the uk, but if she stays out of the uk for more than 2 years she would lose her ILR anyway, and have to apply and pay again.

if you've been married and living outside the uk for more than 4 years, she could apply for ILE without having to be in the uk 2 years thou.but stay out of the uk for 2 years or more you would lose it.

not much you can do but a VV
