It's become clear recently that the BIA has allowed people with spouse visas who had delayed their journey by more than 28 days to still apply for SET(M) directly, though I'd never seen the BIA state exactly under which circumstances before.
If you have that in writing then I don't see why it's not safe to apply for SET(M). If you are still worried why not phone them up and re-confirm?
