    Cant sleep bcoz of ILR

    Im new here, pls i need your help.
    Please tell me what to appy. Is it ILR or FLR
    I arrived UK Sept 15,2007 and my spouse visa will expire June 14, 2009
    I will have then 31 days lacking to complete the 2 yrs stay requirement.
    dont know what to do.

    A liitle bit background, me and my husband being together since Mar 31, 2005 but got married Mar 7, 2006

    Also, do you think i could get visa even i didnt work ever since? My husband is very ill at the moment and we are in the process of figthing Cancer.

    Your advice is highly appreciated. thank you

    I take you currently hold spouse visa?

    You did not entered the UK within 28 days of received of your spouse visa.

    You must apply FLR to extend your visa.

    Gather all your supporting documents, if its possible submit all your proofs you may have since the day you meet your husband or the day you got married upto present.

    HOWEVER

    I maybe wrong.. they said the rules has changed about completing the 24 months of stay, it is now 27 months.

    I just dont know what date they changed the rule. Im sure other members here will help us.

    thank you Lady, yes i got spouse Visa. and i enter uk after 31 days. I regret we didnt know earlier the regulation. Thank you for your concern and help.

    I maybe wrong, but I think that the qualifying period for ILR is still 24 months, the only thing that has changed is that they are now issuing 27 month settlement visas. This means that people can come up to 3 months after their visa is issued and still have been living in the UK for 24 months when it is time to apply for ILR, whereas before, they had to travel to the UK within 28 days to be able to qualify.

    Late last year some people with 24 month visas were being told that if they had delayed their journey by up to 3 months they could apply before their visa ran out, and their application would be put on hold.

    Even though we gave you an advice still the best to phone the Home Office and tell them your situation and ask for advice.

    you would have to apply for ILR 2 months b4 your suppose to

    you need to phone UKBA and check with them, but you must apply for either FLR or ILR before your visa expires on the 14th of june.

    i think they would probably tell you to apply for ILR and they will not process it, until you've been in the UK 2yrs - (up to 28 days)

    or they could tell you to apply for FLR which probably will be granted til the 15th sept 2009, but you would have to apply for ILR b4 then, expensive

    have you passed the 'life in uk test' yet ??

    you don't need to have worked, but have you read the guidance notes for the set(m) form??, you need i think its 5 or 6 pieces of evidence with both your names on...

    phone UKBA and check with them thou, but if you can, your better applying for ILR.
