Citizenship Am I eligible Now?????

I am Inquering regarding Naturalisation,I was granted a 2 years spouse visa OCT 11 2005,came here in the UK NOV 2005, Diddnt apply ILR on 2007 wasnt aware that have to take the test, but i've got my ILR now applied this March 2009 IN PEO cost a fortune but it was definitely worth it i dont want the hassle of waiting hehe , So am I eligible now For citizenship since i've been here in the UK nearly 4 years this NOV 2009?

Im not sure if you're qualified to apply Naturalisation yet, maybe or maybe not you'll have to wait for 1 yr after received your ILR before you can apply for Naturalisation. Why did you left it so long?? The Naturalisation fee will go up AGAIN next month. The best thing to do is to phone the Home Office ASAP to ask them about your situation.

spouses of british citizens do not have to wait for a year after they get ILR. They can apply on the day they are granted ILR so long as they have been in the UK long enough ie 3 years, and not too many days outside of the UK.

So the basis of the 3 years qualifying period is the stamp on the passport when they arrived in the UK right? And for the fiancee visa is it based on the date of marriage?

The 3 year period start when you are physically here in the uk. yup, when they stamp your passport on your arrival as i remember regardless if it is a fiancee visa when you get in the uk as long as you are a spouse already when you apply for citizenship and stayed for 3 years and you have your ilr already.

Ill be phoning the HO soon, i've e-mailed them already still waiting for their reply, the officer in PEO glasgow said i am indeed eligible to apply now coz i've been here 4 years in NOV, but i just wnat to confirm this with the HO,thanks alot

Thanks Ann07. I understand that for spouse visa the basis of the dates is the stamp on the passport.

For fiancee visa holders what is the basis of the dates? Is it the date of marriage or the date the FLR was approved? There is a difference of 4 months. Date of arrival was April and got married in July, FLR approved was in August. So counting the 3 years qualifying period starts when?

In my case i was on a fiancee visa when i get here oct 2006. So i will be 3 years this coming oct. I will be applying my cit then

Time here on a visitor visa wouldn't count, but if for example you came here on a student visa, then got married to a British citizen, that would count.

One thing to remember is that when they first process your application you must have been in the UK exactly 3 years ago.

yes, the date the HO receives your app, you MUST have been in the UK that same date 3 years earlier.

so it might not matter if you been here 4,5 years or longer, if the HO get your app say 12/04/2009 and 3years earlier you was in the phils from say 10-24th of april 2006 you will not get citizenship you should have be in the uk on the 12/4/2009, so check your passports and dates, and you might have to delay your app if you was out of the uk 3 years ago
