    Smile ILR Granted in 8 Weeks

    My wife just got a letter informing her that her Indefinite Leave to Remain has been granted, so she's very happy and relieved. It took 8 weeks for the application to be processed.

    She was worried about it, but I'm sure there was never any doubt that her ILR would be granted. She's been working here as a nurse for over 5 years, is married to me (a British citizen) and is the mother of our son!

    But I wrote a letter to my MP complaining about the cost of the application and asking for an explanation. She thought that they might think that we're "trouble makers" and that this would affect her application!

    So next is her driving test and then citizenship.....!!

    i emailed my MP about the costs of visa's and why Europeans don't have to pay but he never replied

    its costs me £4000+ for visa's for the wife and kids, but a week on Tuesday my wife will be a British citizen and its the end of the road for the visa game for her

    How does this affect her ability to work? The reason I ask is because you cannot apply for ILR until the last month that FLR is due to expire. If it takes 8 weeks to process then there will be 4 weeks not covered by a visa. My wife is due to apply for ILR in August

    My wife was on a Work Permit and she couldn't apply for ILR until the last month. But as long as the application has been made, she could still work, even if it took them 6 months to process it!

    Thanks Jamesey, that puts my mind at ease. How do we apply for ILR? Is it the same process as FLR? I mean visit the same place etc. (with the only difference being the Life in the UK test of course)

    Actually, I was very impressed with the service from my MP. He responded immediately to my letter, stating his intention to pursue the matter with the UK Border Agency. A few weeks later he wrote again, attaching the response from the Chief Executive of the UKBA.

    The main reason for writing the letter was to formally register my objection. It was good that they took my complaint seriously and responded.

    If enough people object, they might consider reducing the charges, especially if they realise it will end up costing them votes!

    it's called section 3c protection ..

    Section 3C of the Immigration Act 1971 provides that, where a person applies for a variation of leave to enter or remain in the United Kingdom and this application remains undecided by the date on which their leave would expire, leave will be extended until the date of any such decision and thereafter during the period in which any appeal could be brought or is pending. These Regulations specify that an application for variation of leave is decided for the purpose of section 3C when a notice of decision is given in accordance with regulations made under section 105 of the Nationality Immigration and Asylum Act 2002 or when a notice of decision is given in accordance with section 4(1) of the Immigration Act 1971.

    in other words, if you apply for a new visa before your old visa expires, and your old visa has expired while the HO decide, then your old visa will be extended until you are told the decision of your visa application.

    To be honest, I don't know! My wife was eligible for ILR without me and started the application process before we were married.

    There are probably other members here who can answer your question better than me.

    Thanks. Her FLR expires on August 7th so we'll apply some time in July. We'll need to sort the life in the uk test before then so she'll need to get studying and i'll help by asking her questions ! I take it the application for flr is the same as ilr. From what i gather the difference is that you need to provide about 20 items of mail with your partners name and address. But do we still visit the same centre and where do we download the forms to be used?
    Also, if we planned to go on holiday in september and the ilr has not been processed, how will this work?

    your right about that, maybe your wife doesn't know about some work permit holders are organising themselves to lobby mp's, inform the press about a possible JR on the change from 4yrs to 5yrs for work permit holders before they could apply for ILR, as some people on HSMP won a court case, challenging the change from 4yrs to 5yrs, and it looks like some of them will be able to apply for ILR in 4yrs not 5yrs..

    but most brits are too lazy or don't want to rock the boat to protest about it .

    anyway i voting for someone who'll rock the boat - ukip

    i take it your a brit married to a filipina who was on a fiancée visa?

    it's a similar process , but i think its only 6 bits of evidence now, not 20 !,
    not the same app form as you need set (m).

    you can post the form, but you might have to wait 8wks or more, but if you go to a PEO you can get your ILR in most cases same day, but it will cost you £200 more

    cost by post only £820, at a PEO only £1020

    Yes, we got married in July 07, got flr at start of august.
    You're right, it's only 6 pieces of info needed, i just checked the set (m) form on the website. That's better, when we applied for flr the guy told us it was 20 documents at that time. Not sure if we'll pay the extra £200 or just post off the stuff. Will decide nearer the time. I can see why post is more attractive but I hate sending so much important personal info by post, knowing how often our government lose important documents

    We'll probably need to change the date of our holiday to later in the year. Thinking of going to Goa if we can afford it

    it use to be 20 bits of evidence, but they recently changed it to 6, i think because many people struggled to get 20, but now some people are complaining about getting 6 you cannot win

    well if you apply by post, you will not have your'e passport for 8wks or so, could be longer, it use to take only 4wks.

    same day would be better if you can afford it
