newbie here and needs advise pls..

Hello to all,
I've been reading this forum from my hubby's account and just decided to create my own.
I just want to ask something and hope I can hear a good advise from you.
My 2 kids from my ex-partner and I came here at the same time.We arrived here 4th of June on spousal visa and kids as dependants.
Someone told us to apply for child benefits for the kids and my husband called child benefits department but they asked him what was written on our passports.My hubby told them,'no recourse to public fund' and they said we're not allowed to claim such.And that's it,my hubby said to me,kids are not entitled to any.But still,someone is insisting that kids should be entitled to this benefit esp that my hubby's working and paying his tax.
Anyone here with same situation as mine?Any advise would be much appreciated.

it might they are confused when you said child benefits we called it child allowance, your children must entittle of child allowance from the gov.

My wife claimed Child Benefit as soon as my step-daughter arrived here in 2007 and she even recieved some back payments. She was also on a spouse visa (no recourse to public funds) and she even got some As far as I know, Child benefit can be claimed by anyone who has a child or children, regardless of their income, regardless of any other benefits that the childs parent may be claiming and regardless of immigration status. If you do not claim it on their behalf, then your husband definately should.

Possible dangerous ground the Home Office .pdf I sent specifically refers to Marriage Visas and Child Benefit.

I'd have thought rather than relying on any heresay posted here the best advice for Stuana is to phone the Child Benefit Helpline on 0845 302 1444

My Filipina wife came here on a spousal visa in March this year. As we are BOTH older people WITHOUT dependants, regrettably neither of us is in a position to advise. But as far as I can make out [from reading others' posts] there would seem to be conflicting opinions about your eligibility (or otherwise) for claiming Child Benefit/Allowance.

Your husband can claim for your kids. Quote that from the Govt website

When to claim Child Benefit
HM Revenue & Customs (HMRC) can only backdate your Child Benefit for up to three months from the date they get your claim. So it's best to make your claim straight away to avoid losing money.

You should claim Child Benefit as soon as:

your child is born
a child you're responsible for comes to live with you
you adopt a child who's living with you
you start paying towards the cost of looking after your child unless they live with someone else who's already getting Child Benefit
If your child has died and you want to claim Child Benefit for them, you should do so within three months of the date your child died.

those notes are aimed at non Europeans, but if his wife doesn't have ilr at least she should not claim public funds.

but if her husband is a brit, there is nothing to stop him claiming for them,

he will definitely get child benefit, i think that's about £132 a month for 2 kids, and step kids are counted as his own.

also depending on his income, he might be able to claim some tax creds, you both have to fill the form in, BUT only your husband can claim it

you should have not problems getting ILR while your husband claims child benefit or tax creds, as long as he's working you should be fine

Quick reply for you as you post in my thread dear, your husband can claim the kids allowance, loads of members here got the kids allowance from govt, not you definitely, it was your husband, I would rather let you contact on her profile one of my friend here, but seems they are too busy also, adam&chryss, she isnt allowed to claim benefits but her son got the allowance from govt from her ex, but Adam was the one whos claiming it, good luck hope you will sort it out soon

Indeed this is the case.. I have three kids, with my Filipina wife, they are 16, 18, and 20. Child allowance continues to be payable up until the age of 19, as long as the kids are continuing their education on recognised course...
