    As others have already said, overdrawn bank statements are a big no no. You need to show that, on paper, over a six month period you are solvent, ie more going in than coming out on most of the monthly bank statements. You don't mention whether you submitted evidence of you savings account as well, but if not, this is also something that would help a lot.

    You may think that you are solvent, and given what you have said about your savings, I would probably agree, but the ECO would make his/her decision based on the evidence you sumbit and if the evidence he/she is given gives the impression that you are living beyond your means because you are regularly overdrawn, then he/she will normally decide that you probably won't be able to support your fiancee in the UK without recourse to public funds.

    yes maybe but i will let solicitor negotiate the eco to reconsider app ive paid them now.bt if it needs to go to court i willk poss not pay them to do so

    i don't know about cancelling it, you might as well sort your bank statements out and see if your refusal is overturned b4 it goes to AIT, if its not overturned nothing to stop you getting ready to apply for a fresh fiancee visa with stronger evidence and good bank statements, then if you've not heard anything from your appeal and your ready for a fresh app, apply for a fiancee visa again then cancel your appeal.

    Good point dont you have a small amount of time to appeal to the ECO your self? Before it goes to AIT.

    So if your still in that timeframe it maybe a fairly quick process from what i have seen it seems its less hassle for the eco to approve rather than deny as less paperwork and effort in the long run

    most on here have had to wait, i had been chatting to my now misses for more than 2yrs b4 we first met, then we had to wait more than 2yrs for her to finish uni and another 4 months wait for the spouse visa..

    you'll get there in the end.. just like most of us, we've all had to sit and wait ..

    Does you account clearly show monthly income.. about £3000 monthly income should do kit with no overdraft carried over into the following month(s).

    You say you have plenty of income as an electrician.. are you self employed??

    Wasn't it mentioned a few years back that it was bascially income support amountamount per week or thereabouts which was used in appeals?

    I think i worked on i needed at least 250 quid a month free after all my outgoings and what not free. please note this was about 5 years ago so the figure will be higher.

    your right andy, its what you would roughly get on income support/job seekers allowence as that figure is what the gov says is the minimum you need to survive on, and some AIT judges use that figure as a minimum you need to support you and your spouse..

    but its after you've paid rent and community charge not after you've paid everything..

    No wonder we passed with flying colours all those years back I was ensuring i had it after every bill even a small amount for food, social and savings

    ma man has to wait too for me to finish UNi majoring in english as well for a year,,,but im an artist,love the ARTS n MUSIC,,,me want to be a makeup artist though...If im there,i want to go trainin and go to school for makeup artists,,,

    so spouse visa is much easier jo than fianc visa then?

    I felt so sorry and Im really sad for the result of your visa...and hope it wont affect the love you had together and just please dont give up on her...my husband and I have been together for almost 3 years now..but for all the cries,the ups and the downs that were not together were just keeping our hopes up
    and finally we've got our spouse visa approved just 1 day and really GOD is listening..

    and the miracle was he got no savings at all...but he is not over drawn tho. but we just explained everything and make that all highlighted..and be as specific with our papers as we can and make that all transparent for them aswell..through an advice of our Agent from the Uk...IVS..

    tell your wife to speak to me..I'll do my best for her not to be sad....I am Chuckie from Cebu..

    We just need to pray...

    her situation is truly wonderful. Swayze, I think that the best thing now for you to do is collate everything you have been advised here in this topic, and also, hit the search button, and check out all the past advice, and re-apply.

    I hope you get the visa the next time. U just made a few "rookie" mistakes
