Main Applicant Lost Job Over A year Ago...

Wife of a friend lost her job over a year ago, that means her WP is also cut. If they stay here for that long means they are illegal. Wife again got a sponsor and file for her WP, but to my understanding since she lost her first WP then there is a possibility that she would be denied as she has no work for over a year? The husband continues to work, but unknown to employer that he does not have legal WP or dependant visa, means that the employer could be fined £10,000 if found out?
So I am asking what is the best solution to their situation, go home and apply or wait for the current application before deciding if in case it will be denied?
I told my friend not to tell anyone as if there will be some grudge against him, he will be reported.

I'd wondered the same thing myself at first ... but from the nature of the post, I imagine it's a Work Permit.

if i remember correctly once she lost her job she had 28 days to find another sponsor or try another visa type (eg tier 1 is she qualified) OR i think if her employer informed the H/O she no longer works there, then she might have got a letter from the H/O stating she had to find another sponsor in 28 days or leave the UK, but no job after a year

and she has applied for another work permit, i take it she has heard nothing yet from the H/O ?

after 28 days, never mind a year i think there is a good possibility she will be denied a visa, and her husbands visa, is dependent on her having legal status to work.

not sure if his employer will be fined, because i take it he was legally allowed to work when he started there and they checked his visa?. maybe if they do a yearly check on his status he will have a problem then and his employer ?

Would recommend proper advice from an immigration lawyer in something like this.
