    Which Visitor Visa to apply for?

    Hi all again.

    I need some advice as to which visitor visa to apply for. situation is.

    Wife is only 20, not 21 till Sept and we need to move back to the UK within the next 4 weeks or so.

    We have been married since Dec 09 and we have a son (nearly one now) son has a british passport

    We are currently living in Brunei, (i have a work visa here and she has a dependants visa)

    The problems are we cant apply for settlement visa yet due to her age (*under 21)

    My wife has just returned from the uk after a two month vacation. (6 months visit visa was granted and is still valid up to april.

    Ok ill stop babbling on and ask the question which visitor visa should i try and apply for now?

    1. General One year visit visa
    2. Family Visit Visa, (none of her family is in the UK, BUT my family is, which is now her family,

    QUestion 3, in September can the visitor visa be changed to a settlement visa? (I understand she would have to do all the tests etc and thats not a problem.)

    I don't have issues with Money, Place to stay etc.

    I can also show to the ECO the following.

    1. Letter form my company saying I am being sent back for some various contracts in the uk for the next 1 year, (splitting my time between UK and Asia) and that my wife will travel with me sometimes coming back to Brunei of I will be away for more than a month

    My wife has had 2, 6 month visit visa's approved in the past and always left the UK with no problems

    It would be great if someone could point out which visit visa is best (or most likely to be granted) and also if during the visa when she is 21 we can change it to a settlement visa. (we are thinking to move to the UK permanantely) getting a new job etc, obviously i wont be stating this on the visa forms yet.

    all your help and advice would b much appreciated.

    no your wife cangt change from a visit visa to a settlement visa, she needs to go back to the country where she is a legal resident and apply for a settlement visa, as she needs entry clearence, she could try and apply for FLR on a visit visa, but the HO will probably take a long time to process it and probably refuse it.

    to be honest i'm a bit surprised your wife got 2 visit visa's, were you living in the uk when you applied for them ?

    I have spoken to the british embassy in Brunei since posting my original question, I will give the asnwers below, (maybe it will help someone else)

    Unfortunately the embassy here no longer process visa applications, its all sent to Manila. (the visa lady told me today they would have given it no problem, but its outwith there control

    FAMILY VISIT VISA for 2 years, as if for any reason its refused we can appeal against it

    I was stationed in Brunei, the two visitor visa's were issued for returning to the uk for a holiday only, both approved no problem. When i spoke to the embassy here in Brunei yesterday she told me that a two year visa should be no problem to get so heres hoping, we have to submit all th paperwork tomorrow so fingers crossed

    I'm sure you already know this. But a regular 2 year visit visa does not mean you are allowed to stay in the UK for 2 years. You are only allowed to stay for a maximum of 180 days (6 months)
    It is a multiple-entry visa with defined conditions/limits on the length of stays in UK per 12 month period.

    If any of the specific conditions are breached, you face a future ban of up to 10 years.

    i thought that, but didn't want to look a if i posted it and was wrong, if your not in the uk, your problem could be showing you have suitable accommondation which is not over crowded for her, but if your already in the uk, the risk of refusal would increase for a visit visa for her, espcially if she is under 21, becuase the embassy could say shes coming to the UK on the wrong type of visa , not as good idea applying for a VV if your already in the UK.

    Hi Joe bloggs,

    Yeah i think applying for that one in the UK would have been impossible,
    Thankfully e can show, (by a letter from my company....i have an understanding boss) that she is allowd to travel with me while i am working on a project, basically everything they need to hear.

    My aim is actually to get a another job while i am in the UK so we will be based permanantely, but we would have to be careful with our dates. (the embassy in Brunei said, we could try buggering off for a couple of weeks holiday and upon returning to the UK, if the border agency thought we were getting close / talking the piss they would give her a warning first and also advise her on how long she has left before she needs to get out for a certain amount of time.

    Hopefully the appeal by the goverment gets kicked out quickly and we can just apply for a settlement visa asap. either way i will get a couple of weeks holiday back in Manila at some point...always some good with bad
