    Question Overdrawn Bank Statements.

    Hi all,

    My mahal and I just got married this weekend and we are going to apply for FLR-M very soon.

    She's on a student visa which runs out in November and we are both in England.

    We are either going to apply in person or post. I own my own home and have done for 3 years, have been working at the same company for 4 years and have all my wage slips and can get them to write me a letter etc and we have all the docs/pics/letters/cards you'd need to apply for the visa.

    My only worry is that all my bank statements are overdrawn as I have been living in my overdraft since i ever got one.

    Do you think I shouldn't bother sending my statements?

    Also I have no savings whatsoever, do you think this is a problem?

    My wife and I are also expecting our baby in August, assume this helps us a wee bit as how can they split up a family.

    Any advice, thoughts are muchly appriciated.

    re:FLR ......it's a question that's been asked a few times (overdrawn statements, limited savings etc) and no definitive answer.

    From my research (and others on this site) I don't think we're aware of any Filipinas who've been refused the FLR because of financial "problems" (eg overdrafts, husband's redundancy etc etc), but it's also been pointed out that people in other communities have been refused.

    From my point of view, if the bank is happy enough to continue to "fund" your lifestyle, then the UKBA is likely to wave through the FLR.

    Bluebirdjones is quite right. There are no regulations regarding bank statements and overdrafts. Technically, maintaining your finances within your overdraft limit is not considered living beyond your means for immigration purposes.

    The HO is looking at your overall cash flow/financial capability. Means can you manage without recourse public funds.
    It's never good to submit overdraft bank statements , but my best guess is that for FLR as long you have been maintaining income cashflow and have evidence that disposable income meets what is expected then I think you should be OK
    Maybe you using your overdraft facility to go partying or spending on designer clothes.
    Just joking there, but what I mean is, you can spend your money on whatever you want as long as the necessary non-discretional spending is within income range.
    Does that make sense?

    has your wife taken the english language test ?

    terpe and bluebirdjones are right not many are refused flr, if it was one bankstatement then it could be a secondary reason for refusal, all bank statements over drawn could be a primary reason for refusal, and that risk could increase if you have £0 savings as your wife doesnt have recourse to public funds, but your working, a letter of support explaining why your over drawn (wedding, etc) and a budget showing your spendings and you will have £105 a week at least after paying rent council tax, you should be ok with a bit of luck,,

    have you any parents, fmaily etc who could provide 3rd party financial support ( it could well be accepted) ? if so a letter of support from them could help , reducing any risks of your wife needing recourse to public funds,,
