    Ilr application date

    hi all
    i know some of you may think ahhhh not another one, but here goes.
    on 01/sept/2009 my now wife(filipino) was granted fiancee visa to uk (6months validity) she arrived 17/oct/2009 and we got married on 12/nov/2009. we applied for her FLR on 6/jan/2010. shorlty after, she recieved her resident permit card that states it is valid untill 6/jan/2012.
    my question is and correct me if im wrong, the earliest we can apply for her ILR should be 9/dec/2011 which is 28 days before her expiry date(6/jan/2012), and the last date the UKBA should recieve our ILR application is on 6/jan/2012.

    Hi sammy,

    ILR is available for application after a qualifying period of 24 months from the settlement visa (FLR) ie: The period from the time permission was granted to remain in the UK as the spouse (if your spouse arrived here with fiance visa this is a temporary visa and is not counted).
    The FLR of your wife expires on 6th January 2012, which is exactly the 24 month qualifying period.
    Now, the ILR application can be made 28 days before the end of that qualifying period.
    Which means she can apply for ILR on 10th December 2011 (hope my calculation is correct)

    I would highly recommend you take a look at the ILR application form and Guide just to be sure you can provide a fully compliant application.

    Don't forget Life in UK Test needs to be passed before ILR application.

    BTW sammy, Naturalisation (UK Citizenship) she can count from when she first arrived in the UK so this can include the fiancee time.

    many thanks Terpe, knew i could count on your info.
    she has already done the ESOL with citizenship material,with UKBA accredited college, we done this last year just in case they decide to change any rules and found it easier as it got her out of the house and into a college routine.
