    hello

    Hi all..I have been looking online for answers to my questions about spouse visa. Before I signed up for membership here, i read lots of threads here and its great to find this site...such a very informative and useful place to read about my queries.

    I have a 5 year old girl and am married to a wonderful British man. We have been living here in the Philippines since 2006 thinking life would be better because cost of living here is a lot cheaper than in UK. After years of staying here, we realized its not as easy as we thought it would be for us to live here especially my husband couldn't really get a job here. He had to work abroad and had to be away from me and our daughter most of the time.

    So now, me and my husband is fed up of being away from each other because of his work, considering we have a growing child. We now both have decided to go back to England. So here comes in my questions.

    1. Will I have a chance to be given a spouse visa? considering that I have over stayed in England for over 2 years. This is because I thought I had a legal UK work permit. I went to England on a tourist visa and when I get there I met someone I thought can help me work in UK. I had to pay this person and she managed to get me everything I needed so I can get a job in England on a proper visa. So I did get a job and there I met my boyfriend now my husband. I got pregnant and we wanted to get married then in UK but I learned my visa was fake so I had a voluntary exit. Came back to the Philippines with my man and my daughter and lived here since then.

    2. How much money do we need to have in the bank to convince the ECO that we don't plan on using public funds to support ourselves when the family goes back to England? I understand they don't say a specific amount but at the moment we don't have that much money in the bank..We have like 2000 UK pounds in my husband's UK bank account and about 3000 US dollars in our pocket. Would that suffice? Me and my husband do intend to work when we get there.

    3. My mother-in-law offered her place for us to stay for as long as we want once we get to England. Is that a valid or suitable accommodation for my family that the ECO would be happy to consider? Me and my husband are thinking, we can't really pay rent yet in UK while we are still here in the Philippines because that would be a waste of money considering I am not 100% sure I will be given a visa.


    Any information would be great. At the moment, my husband is in the process of healing because his bicep tendon snapped while he was working abroad. He's got no job at the moment too..so we're a little tight really and I'm working on a minimum wage here in manila. That's why we need to know if I am qualified to apply for a visa otherwise, we don't really want his hard earned money to go to waste. And we want to go back to England mainly for our growing daughter and for the family to be always together. It really is not nice to be away from your loved ones.     I think you may be qualify to to apply for ILE (Indefinite Leave to Enter)since the family live outside the uk for more than four years.

    I agree with 'sars' , the previous poster, and I think you will have a good case.

    The status of your child is important.
    IS SHE A BRITISH CITIZEN ?

    I have been through a similar situation to you and your partner....me working away for long periods, with wife and children in the Phils, then all needing to return to UK (for childrens' education).

    In my case I went on ahead back to UK to arrange a job, and accommodation for the family. I had bank records from my Hong Kong bank.

    Then I was able to satisfy visa requirements for bringing over my 2 stepchildren as dependants of my wife, who already had settlement visa for UK.

    Hi..thanks for the quick reply..my husband just arrived home last week but we are going to get our daughter a british passport first before I will apply for my visa. Its taking a bit some time because they require me to get a CENOMAR from NSO to see if I have a marriage record I suppose and I'll get it next week...then we can apply for our daughter's British passport. I'm glad we are on the right track then..Thanks for your confirmation. I'm still worried about the fact the overstayed in England though...I hope they will not take that as a negative thing that will affect my visa application. I would appreciate it though if any body could answer my 2nd and 3rd question :-)

    at the moment, she got Philippine passport we got her from London before we left England but a few years back when me and my husband went to the british embassy, we were told our daughter is qualified to apply for a british passport..i hope it didn't change since then..

    Yes, of course that is possible, but it will make things much easier for visa applications if your husband comes here first and arranges work and accommodation for you all (with letters from employer and landlord).

    It shouldn't be difficult for him to do, and at least you will all have somewhere to live here !
    I would not recommend staying here with family or friends. You need your own place, and the visa people will want that too.

    Do try to get a British passport for your daughter.
    It will make your lives MUCH easier in the future.

    have you been served a notice or form when you left UK for overstaying?

    regarding your questions 2:
    you must only satisfy the ECO that when you settle in the uk your sponsor can support you without recourse to public funds.
    regarding number 3:
    yes you can use a 3rd party sponsor but you have to submit all the required details as per accommodation is concern
    ie, letter from your mother-in-law,mortgage documents,no overcrowding etc...

    get your daughters british passport as she is a british citizen and she is entitled to it...saves you extra cash as she will not be paying for a visa to go here in the uk.

    On the question of your overstaying I don't believe this should present a problem under 'normal' conditions.

    The Immigration Rules are here

    Please look to 320(7B) and 320(7C)

    However, can you comment on the following which MIGHT have some impacts:-

    - did you leave voluntarily?
    - were public funds used to assist your departure?
    - during your overstayed period did you seek treatment from the NHS?
    - as sars mentioned, were you served with a noice for overstaying?


    Please do not be too concerned about this, just be honest so that additional verifications can be made as to possible impacts.
    I still feel your settlement application will be OK

    no i don't remember receiving a notice like that but I did sign a logbook at the airport on my way back here in the Philippines and the guy wrote my name and I can't remember what else and got me to sign it...he even spelled my name name and I corrected him...anyways, he wrote "seen passport and the that day's date" in my passport and let me and my daughter get on the airplane.

    I empathise with your situaution as it's similar to ours, I came to the RP as a single man and found employment that was enough to live on. Throw a wife and a new baby into the mix and life gets a whole lot more complicated, so we are heading home. Good luck with your quest.

    Hi sars,

    Me and my husband's looking into applying for a SPOUSE VISA but you said I can apply for ILR. I've not read anything about ILR so I'm confused now. What visa will I apply for? and if I am qualified to apply for ILR, does it mean I don't need to take an English Language Test?

    Please advise..thanks

    Hello again Sars,

    I just read about ILR. I will have to apply for Spouse Visa then if they're satisfied and grants me with Spouse visa then I have the chance that they might give me an ILR once I arrive in England. For now, I will book for the English Language test. I can't believe the test cost 8640 pesos though...a bit overpriced i think thanks sars and all for info and advice...

    Hiya! the price is a bit expensive really. Coz they will only be asking you basic english to know that you can really communicate while your here. And I tell you even if its expensive for us, it's actually the cheapest one. When I was looking for a Agency to do my English test there's an Agency who was asking for 15k and you'll get the result in 3 days. I told my fiancee not to go for that one and just wait for 15days and get the cheaper one cost it's not practical. So goodluck with that and Godbless..
