    Re indefinite leave to remain ? help advice

    Its been almost 2 years now since my wife Deanna and our son Ben arrived in UK on her Spouse Visa. They have settled nicely. Ben already at school.

    In Feb 2012 my wifes visa will end. It is a worry because only recently i have had a heart bypass operation. This as meant i was unable to work. Our savings have slowly disapeared and im left with a big worry. Im ex-army so i know the Royal British Legion are trying to help.


    So February 2012 what happens if i am unable to show funds to pay Deanna's ILR.

    At this stage im asking here rather than ring the UK Border Agency

    not many people are refused ILR, with your son here she should not be deported, if the worse come to the very worse.

    so save what you can, see if a family member can loan you some money til feb next yr.

    i doubt your wife will be refused, just apply b4 her visa expires, has she taken the 'life in uk' test yet ?

    many people have got ilr while thier spouse is unemployed, you shouldn't even need any savings, thou it would probably help..

    what they are looking at are, your still living togther (i hope you got some bills etc in joint names ??) and that your wife hasn't needed recourse to public funds .

    of course you can claim what ever your entitled to, thou your not allowed to claim 'more' of a benefit becuase your wife is living with you. are you claiming child benefits, tax creds ?
