    Spouse Visa Issue

    Hi everyone, really glad to find this forum and have already found some excellent information.

    I'm just looking for some advice on my current issue. My Filipina fiance joined me in the UK a couple of months back on a fiance visa. We had every intention of being married here, the date was set and arranged.

    However, we have since had second thoughts and are considering marrying in the Philippines instead. As I understand it, she would have to go through entry clearance again and this time on a marriage visa. My concern is, will she be considered as having an immigration history if she does this, as we did not go through with the marriage in the UK?

    Hi there MK, welcome here.

    You are correct, if she returns and you marry in Phils she will need to apply for spouse visa and comply with all requirements.

    Each visa application is reviewed on it's own merits. There will be difficulty in your circumstances provide she does not remain in UK after expiry of her visa.
    Just provide short explanation in your support letter as sponsor.

    Thanks Terpe. I've had issues trying to get an answer on this from the Border Agency but my reading is the same as yours. It would just be treated as a new application.

    You could have a simple regestry office wedding here to comply with the visa, then have a biger family wedding in the Philippines?

    I agree with Mick.

    You'd be daft not to take the opportunity IMO.

    If it's to do with family issues here...no need to invite anyone except witnesses, and cost is minimal.
