i know i have posted this before( last year) but am bit worry of the different replied that ive get
sorry but i want to make clear as few months now ill be applying for ILR

my details on my passport is like this i arrive in the UK VIA spouse visa and stamp by the UK IMMIGRATION 20TH OF MAY 2010
on the visa itself the valid date FROM 29th of March 2010 valid until 29th of June 2012
so my question is when is the exact date for that 28 day to apply my ILR?? ANY IDEA

Hi

You have to be in the UK for 2 years minus 28 days before your application for ILR will be valid. The starting date for the 2 year period is the day you entered the UK on May 20th 2009.

So your application for ILR can be accepted by the Home Office anytime after April 23 up until the day your spouse visa expires in June. So if you apply before April 23 you will have applied too early and they will just refuse your application. If you apply after your spouse visa expires in June then you will be an overstayer!!!

So just to be super safe apply for your ILR on May 1 2012.

We did it last year. Wife came to UK on June 9 2009. Applied ILR on May 13 2011. That is 2 calender years minus 27 days. She could have applied anytime after this date right up until the day before her spouse visa expired.

I think that you are confused because you may be under the impression that you must apply for your ILR on only one particular date. That is not the case. The Home office will accept your application on ANY DATE from April 23 right up until the day before your spouse visa expires.

Arthur was correct in his initial answer in the previous thread.

your arrived into the UK on the 20th may 2010 therefore your 2 years residency period is on the 20th May 2012, 28 days before this date is the 22nd April 2012 BUT as this date is a Sunday its best to say that the date you can apply is between the 23rd April 2012 and the visa expiry on the 29th June 2012.
