Hello Every one,

I'm Stuart and I'm here trying to find information about getting my girlfriend into the UK, I've read all the links but so far I have not been able to find an answer.

My problem is this!!! I'm disabled and in receipt of benefits. This means I fail the requirements criteria!!! Does anyone know the solution to this? It seems unfair that I'm unable to marry the woman I love. She is stuck in Cebu!!!!!! Is there anyone else thats hit the same problem and can tell me what I need to do?

Hello Stuart, welcome to this friendly forum

first thing you need to do is planning , plan to visit and met her in person. so, had a possibility for you to bring her in uk, then you can try to apply soon a general tourist visa after meetings.

Stu, i am granted a general visit visa in 7 days.
i met my partner last year 13th of october, he stay with me for 21 days, (happy spending time each other, love blossoms).. when he back to devon, he immediately processing hes documents and send it to me by courier.

i further to explain it to you soon and i will posted it you how we build our application...but as what i said now. MEET HER FIRST

Don't to much worry of your situation that you are disable .. im sure you can get a good lady. just be positive all is well.

Welcome to the forum.
As far as I know the amount of income and savings you need to show the UK Border Agency that you get a month is going up around this April, there are other threads on this if you do a search.

I married a Filipina in the Philippines in 2008, and after some problems (on her part) eventually brought her here to the UK.

The marriage did not last; I divorced her in January this year.

I retired since that application, and from what I believe I could not show now that I have enough income and very little savings to support another settlement visa application.

I would have liked very much to use my past experience to hopefully find a Filipina that did not just want a visa,
But have accepted this cannot happen for me.

All the very best if you go for it as many on here will tell you Filipina’s can make wonderful partners.

all i can say is getting to know the lady before you marry her.. why not?! try to live in the Philippines and stay with her for many months before you go on commitment. i'm sure many filipina looking for true love not after the money.

OK Ive know my girlfriend (Marjorie) 7 months now. And we are meeting this March....

The problem I have is the use of public funding clause because I receive Disabled Living Allowance!!! This is meant to fund the things I cant do. But it seems this is whats holding me back? If I stop the DLA I cant afford to live im in a catch 22!!!

In connection with your concerns over benefits etc.

It's really not possible to make sensible comments on your own specific case without much more detailed information and quite a bit of discussion.

But to keep you as positive as you sound, let me just tell you that in principle there is no reason within current law that your application cannot succeed.

Established case law states that your DLA is to be treated as income for the purposes of sponsorship of a settlement visa, so as long as this comes to at least 50% of the current income support level threshold of £105.95.
This will mean that your spouse/fiancee will be reliant on the DLA proportion of your benefits, rather than any other the parts which could be considered public funds for your support only.

Are you able to say something about your accommodation circumstances?

Do you receive council tax benefit? Housing benefit? or Income support?

It is possible to get a settlement without savings, although of course it will considerably help matters that you have savings, especially under circumstances you have described.

Hope this helps to get you thinking.

By the way Stuart, it's only fair to let you know that there is a chance of increased barriers within immigration policy, and more especially for financials.
No-one can say when these will come into force, but it could be as early as April 2012

Just means you may need to 'clear-the-way' sooner rather than later

Before I go any further Id just like to say a real big thank you to everyone that's replied. My Lady is very positive and it seems that everyone on here is to!!! Joining this forum has to be the best thing I've ever done Ive now talked her into joining and I'm sure she will be joining me on here soon! Know back to my situation. I get Incapacity Benefits. and Income support. And yes I get housing benefit and living in Social housing under a housing assiciation. I am divorced and awaiting my Decree absolute which is due any day now then I'm FREE!!!! I'm sorry I've taken so long to feed back the information requested.... Some 31/2 years ago, I found myself facing much the same financial constraints as you are now ... albeit I was in receipt of Pension Credit - as opposed to Disability Living Allowance - after retiring prematurely from full time work on health grounds.

Suffice to say, I worried endlessly about the impact this was likely to have on my wife being granted a Spousal Visa ... but - thanks to the information gleaned from being a member of this excellent forum - the process was completed far more smoothly than I could ever have imagined.

Yes I have learn from my mistakes, she profesed love for me that was just not there

But fiancially becouse I retired my income is now a lot lower that when when we obtained the visa etc.
I would be even more unhappy if I did meet anouther lady and then could not meet the requirments!

We can only see what life brings us.
