    Changes In UK Immigration Structures

    On March 8, my wife will have been living in the UK for 3 years ... thus completing two thirds of her immigration journey. You'd think, therefore, I would know all there is to know about the process. And - as one might expect - when she first arrived, I felt confident in advising others what steps needed to be taken in order to fulfill their aspirations to stand alongside their English/Welsh/Scots or Northern Irish partners as fully~fledged British Citizens.

    But, since the present Government came to office, I have found it increasingly frustrating to keep abreast of the myriad of new rules that have been implemented - particulary those involving the introduction, in November 2010, of the (in my view) unfair and completely unnecessary Language Tests applicable to Philippines' migrants ... for whom English is the medium of instruction.

    So ... hopefully, members will bear with me as I try my level best to keep up with these, seemingly endless, changes.

    so it means after 3 years living here in the UK AS partner/husband/wife of citizen here ..there are more test before we could apply for citizenship??

    there should be a transition period, so any changes should not effect those who are about to apply for a certain visa.

    apologize joe.. but i certainly dont get what you mean..eg on my case..im about to apply ILR this April AND if lucky the next year my 3rd year .. so citizenship is the next step....does it mean i need to undergo more test..to be able to apply??

    i wouldnt think there will be more tests for you moy as you are already here, the new changes tests i think will only apply to those from a date stated by the authority,

    any kind of changes regarding such things usaly have a transitition period to take into account those such as yourself, i dont know any details or facts, but any kind of changes always alow some kind of fair changeover, dont worry too much about it, wait and see what news comes, as i say i feel sure you wont need to

    if not the gov risk losing any court cases as the judge could rule the changes are unfair to those who could nearly apply under the old rules but not under any new rules.

    Overseas domestic workers

    Restricting all overseas domestic workers (ODW) to only work for the employer with whom they entered the UK, or whom they came to join.
    Removing the right for all migrants under the ODW category to apply for settlement.
    Strengthening the requirement for the employer of an ODW to provide evidence of an existing employer relationship, and introducing a requirement for agreed, written terms and conditions of employment to be produced, as part of the application for entry clearance.
    Permitting all ODWs who have applied for leave to enter or remain on or before 5 April 2012, to continue to be treated under Immigration Rules in place on that date.
    Restricting ODWs in private households to work for an employer who is a visitor to the UK. Permission to stay in the UK will be limited to a maximum of 6 months or the period of the employer's stay whichever is shorter. Removing the current provision for ODWs to be accompanied by dependants.
    Permitting ODWs in diplomatic households to apply to extend their stay for 12 months at a time up to a maximum of 5 years, or the length of the diplomat's posting, whichever is shorter.


    all thou this concerns domestic workers, those that had applied for a visa before 5th April 2012 will be treated under the old rules not the new rules, so i would expect the same for those on other types of visa's, eg Settlement visa's (if not i'm sure there will be court cases )

    Well if the intention is to bring in any new rules for 5th April the announcement will need to come pretty quick.
    I don't think there's any reason why new rules cannot be introduced at anytime after April.

    Lots of people waiting on this one. I still wonder exactly how it will work and on what basis.
    I wonder if where you live will have any influence. Decisions based solely on gross income seems to be a retrograde step to me. It doesn't give a good enough indication of financial viability.
    Just an opinion.

    You Arthur and the rest of the guys who have your wives here should not have any problems. For the people who waiting to get their loved ones here its a different story, Maybe we can take legal action against the government in some way. After all we have spent thousands of pounds to be with our loved ones.

    why still no information, because i think there must be disagreement about it in the gov, the wrath and backlash the gov will get from people it effects, pressure groups and the threat of 'human rights' court cases has them in their boots
