    Exclamation Fiancee visa refused!

    I have just got back from Manila after collecting me passport in person.

    Refusal Letter Decision:

    You have applied for settlement of someone settled in the UK. You have submitted docus to show you and your sponsor, Mr. PAUL MY LABS have met previously in the UK and in the PI. However, THERE IS A REQUIREMENT FOR YOU TO SHOW YOU AND YOUR PARTNER HAVE BEEN LIVING TOGETHER IN A RELATIONSHIP AKIN TO MARRIAGE OR CIVIL PARTNERSHIP WHICH HAS SUBSISTED FOR TWO YEARS OR MORE IN ORDER FOR ME TO BE SATISFIED TO GRANT ENTRY CLEARANCE UNDER THIS CATEGORY. From the documents you have submitted it is clear THAT YOUR SPONSOR HAS REMAINED RESIDENT IN THE UK WHILE YOU HAVE REMAINED RESIDENT IN THE PI SINCE YOU FIRST MET. I am not therefore satisfied you meet the requirements of paragraph 295(i)(a)(i).

    that person obviously doesn't know what a Fiance Visa is or is confused about whether it's the same with the Unmarried settlement visa! I'm sorry for your refusal..you need the start the process for asking reconsideration or for appeal..

    Sorry to hear of your bad news.

    All looks rather confusing to me.

    Exactly what type of visa was applied for ?

    The reasons for refusal suggest that it was an unmarried partner visa.

    Indeed Raynaputi. Can somebody send me a link here or give any advises on whats best to do and faster track aside from re-application? I wont pay 800 odd quid for his stupidity. Eh?

    Btw melovesengland, what application form did you use? Are you sure that you ticked the right box? In the form, question 8.1.1 On what basis are you going to the UK?, did you tick As the fiancé(e) or proposed civil partner of someone
    settled, or going to settle, in the UK
    and not the As the unmarried partner of someone settled, or going
    to settle, in the UK
    ? Just making sure why the ECO gave you that reason..

    I mean he was with me on skype while I am filling up the form. He even review the application form before we printed it out etc etc.

    Well, I don't really know the process of reconsideration and/or appeal at the moment..I'm sure others can help you with that..What I know is if you are going to appeal, it needs to be done here in the UK now..your fiance can do the oral appeal. I hope it won't go to the appeal though and decision would be changed right away via reconsideration.

    Sorry about your refusal in what on the face of it appears to once again to be pointless grounds. Please check your application once again to make sure you applied for the correct visa although I would have thought this would have been done when you submitted the application at VFS. If you are satisfied that you applied for the correct visa then you have will have to submit a letter of reconsideration to the Embassy pointing out their error and hope to get the decision overturned. Please also be mindful of the 28 day limit for submitting your appeal. You are not alone here as my wifes application was quite clearly not read properly when they arrived at the decision on hers. Stay positive and stay focussed on what needs to be done and best wishes to you both

    mmmmmm that is one stressful news! im sorry to hear that. it seems like the ECO didnt really pay attention to your application, but then again we only know one side of the story, but I am sure before u submitted your application you checked and verify everything so I am sure they will re consider your app once you send a re consideration letter.

    heres hoping the best for ur situation and fingers crossed they will turnover their decision

    Seems like the FCO need to sort their staff out, considering the not only expensive, but life-changing processes they're dealing with.

    you need to check your app, did you apply for a unmarried partner visa or a fiancee visa, if you did apply for a unmarried partner visa maybe its possible that you can get a refund for it being an invalid app.

    Aw MelovesEngland sorry about your refusal.. Coz about wrong application did you submit aw lol staff in vfs office did ask about you what did you apply coz I was remember when I submit my application she ask about me and she check my application.Again sorry about to hear the refusal..

    So sorry to hear about the refusal, such a bad news indeed I even thought you must be lucky for getting an email sooner than me since I lodged mine April 19 and still waiting up to now . May God guide you when you re-apply again. Goodluck!
