Maybe if you could have paid by credit card as suggested by Joe's post from the Bahrain section of the UKBA site then as a consumer you may have stood a chance of getting a refund through your credit card company. But as things stand it will be down to you to request a refund. I agree, I do not think they looked at it properly and have pocketed the £800. In my opinion that is fraudulent. The application has not been processed as such.
Quite honestly I don't think some of these ECOs give a crap.
I got no any idea why they didnt notice my photographs or they just didnt bother contacting us in the first place. I have posted the refusal letter message in the other thread and we believe that we did went wrong in that category type cos that's the only unmarried partner in the app, the rest is all fiancee visa topics, docus and proofs. Even the ring photo, invitation card, quota of the hotel and restaurant where we plan to exchange vows was all there and also the receipt of the ring was there, inquiry from the registrar, emails and chatlogs bout wedding prep and plans were all there.
The only thing we knew on paying the fee is either pay it in union bank or use a managers check. They wont refund it too I think sir cos it says on the link provided we shouldve withdrawn the app before they reviewed it. So it is fraud? What do you think is the best thing to do before we will re apply sir?
I really appreciated all of the effort and time, I am very happy to be reached out by the members and headmasters of this forum at this time of crisis. Thanks for the infos, opinions and advices, everything are all appreciated. Once I get tru this stage and got granted I will surely share my experience to the other member of the forum.

i would write a letter to the ECO manager at the embassy and explain what has happened and you selected 'unmarred partner visa' because you thought it was correct for a fiancee. and mention that in your letter of support you stated you were applying for a fiancee visa and if the ECO had read the letter they should have realized about the mistake and why didn't anyone contact you before refusing the visa.
they wouldn't have known from the photos, you could have been applying for a unmarried partner visa, a fiancee or spouse visa.
they should have known from your letter of support, they must have looked at your evidence because they refused you a 'unmarried partner visa' because you didn't submit any evidence that you lived together for 2yrs, how would they know that unless they looked at your evidence.and if they did look at your evidence they should have realized from your evidence that you wanted to apply for a fiancee visa.
ask your b/f to contact his MP, maybe they will do something..
I don't think it will do any harm to write a letter and explain the error and ask for a refund. Perhaps you could also suggest that in view of the amount of money involved you are a little surprised that the ECO quite clearly doesn't read the documentation submitted with the application because it would be glaringly obvious to anyone who studied the photographs and other evidence that this wasn't a same sex relationship. Surely it would have taken anyone with a modicum of intelligence less than 5 minutes to see that there was a mistake on your part. Sorry but I agree with Dedworth if you don't get your money back get your partner to contact his MP. It also shows that it is a pointless exercise using the VFS premium service because they should have spotted it as well.

I think that sometimes, rather than thoroughly looking through the evidence the appointed ECO might well be otherwise distracted.....
i thought ECO's are intelligent people with lots of common sense ...what a rip off spending £800 just for one bloody tick mistake. Total nightmare.
lesson learnt...it only show that application should be precise as eco works like robot on application.
There is nothing to stop disgruntled visa applicants from writing to the Foreign Office in London.
That is certainly what I would do....or is it UKBA now ?
I've often wondered if it would be worth complaining about these ECO clowns to the Parliamentary Ombudsman

In the past I've had a couple of results with the Local Govt Ombudsman and a friend who was a Director of a large local authority told me the ombudsman was what they feared most
