The way I understand this is that the so-called "new rules" were implemented without any approval from Parliament.
Looks like the Home Office/UKBA will need to reconsider their position in light of this judgement and consider what needs to be done to rectify the situation.
My guess is that "technically" any rules/guidance not previously presented to and approved by Parliament will also be impacted and questioned.
Hmmm interesting times.
