    Expired Visa

    my friends visa is expired 3 weeks now.. honest mistake, he count the 28 days before expiry from when he first enter here for the 5 years requirements. can he still apply for ILR? Need urgent advice please..

    Hi shejay, welcome to the forum.

    Your friend didn't need to count anything. A visa expiry date is just that. Period.
    Your friend needs to very quickly regularise their status here.
    This MUST be done within 28 days of visa expiry.
    Better to speak with UKBA asap.
    If more than 28 days has past then have some help/guidance from an experienced immigration advisor.

    Time is 'of the essence'

    do you think if my friends visa is already expired he can still post his application for ILR (set o) work permit route. together with his cover letter with an apolgy and explanation re: expired visa reasons? any case happen like this before here if yes what happen?

    I'm saying your friend needs to act immediately to regularise their immigration status.
    Within 28 days of expiry confirm process with UKBA
    After 28 days of expiry seek professional advice.

    we already ask an advise with a professional... he said big problem big time... he said post the application and wait for the decision... if its granted (miracle) if not from the refusal that the time we can appeal.... do you think its the best way? i know its silly but.... the question is what if it says we cannot appeal... do you think we really really can't appeal even if his employer really want him bad in his company? or the employer of his is the one gonna appeal? thanks... any related case? that you know please share to us..

    yes we did ask professional help already... his advice was still post the application for ILR (even visa expired) wait for the decision... if granted ( miracle) ... if not .. we will receive the refusal letter... the silly question is, what if it say in the refusal letter we cannot appeal as well.. is it game over?
