Looks like the writing is on the wall. There will be a knock on effect globally from the latest in the USA. Samsung will be forced to innovate globally.

"Jurors delivered a whopping blow to Samsung on Friday in their verdict for Apple v. Samsung — to the tune of $1.05 billion. But right away, we can expect the court system to tweak some of the jury’s findings, possibly by increasing the damages that Samsung owes Apple.

“Judges rarely overturn a jury verdict,” Robin Feldman, Professor of Law at UC Hastings and author of the book Rethinking Patent Law, told Wired via email. ”The judge would have to find that no reasonable jury could have reached this decision.” And given the judge’s rulings along the way, Feldman said she would be surprised if Judge Lucy Koh overturned the verdict. “The jury found willful infringement, which opens the door for the judge to award punitive damages. I would expect the trial judge to increase, rather than reduce the verdict.”

After four weeks of trial, Apple v. Samsung came to a close Friday as jurors decided that dozens of Samsung products infringed Apple’s iPhone and UI related patents. If it stands, we could expect higher-priced Android devices and increased product diversity in the future, along with a slew of renewed litigation against Android manufacturers.

On top of that, on Monday Apple asked for a preliminary injunction barring sales in the U.S. of eight out of the 28 infringing Samsung products: The Galaxy S 4G, Galaxy S2 (AT&T, Skyrocket, T-Mobile, and Epic 4G), Galaxy S Showcase, Droid Charge, and Galaxy Prevail. (The others are no longer for sale in any meaningful way.)

Judge Koh now has the option to grant enhanced damages (up to 300 percent) for willful patent infringement, a decision that should come within the next few weeks. Apple and Samsung will reconvene in court Sept. 20 for Koh to deliver her ruling."

Seems Apple are trying to take over the world. I may have some sympathy for them if their products were not so vastly overpriced.

"Carolina Milanesi, a US-based analyst for Gartner, thinks that the verdict is a big victory for Apple, and acts as a warning to other smart device makers.


If you look at all the comments on the decision there are two camps - will it stop innovation or will it push innovation further. I think the latter; vendors will be pushed to be more varied, and that's what they needed to do in the first place.

We are in a world in which a handful of vendors in the same ecosystem are competing - you need to be innovative, you need to be unique, you need to look at what works for the consumer.

For the consumer I don't think it's a loss - why should it be? If you go back to the drawing board and come back with something different the consumer has gained."

The US Patent Office is currently reviewing all the patents that were put forward during the trial as some should not have been granted, and ones like 'rounded corners' should have been thrown out by the judge, and many experts are at a loss why it wasn't. A bit stupid now though, and the Patent Office should have reviewed them before they got to trial. So regardless of what it says above, somethings will change in an appeal.

It also isn't a problem for Samsung to quickly change the products to circumvent the patents it is supposed to have broken, they already have everything in place to knock them out to prevent any ban on sales.

Google are now proceeding in the US courts to have all Apple products banned for breaching Motorola's patents (which Google now owns )

Apple-Samsung court verdict under cloud as jury foreman found to have own smartphone patents

The jury foreman in Apple's landmark legal victory over Samsung, has a patent in his own name for a device that can be used in smart phones and tablets, it has emerged.

Velvin Hogan reportedly filed documents with the US Patent Office in 2002 for the 'method and apparatus for recording and storing video information'.

This also included technology for a wireless keyboard to allow users to surf the web and order films on demand, a feature, which is already available on Apple iPads.

Only in America....it would be quite funny if it wasn't so frightening

The reason that Apple find Samsung so offensive is that its devices deliver much of the same computing power and services at a more competitive price.

The best place to deal with Apple and its fat margins are in the marketplace. But if Apple does not allow that to happen then maybe it is time for the trust busters at the Department of Justice, European Commission and Britain's Competition Commission to cast an eye.

After all, it is not just on supermarket shelves that the interests of business and consumers clash.
