    financial requirement for spouse visa

    i emailed UKBA last friday about financial requirement for spouse .. i also asked them if overtime and bonuses is counted as threshold .. and today i received their answer ..

    When assessing salary, basic pay, plus skills-based allowances and UK location-based allowances (e.g. London weighting), will be counted as income. Any such allowances must form part of the contracted salary package and, if they exceed 30% of the total salary, only the amount which would correspond to 30% of the total salary will be counted towards the financial requirement. We recommend you see the attached guidance on how to meet the financial requirement.

    I think thats an email of the application centre where we submit our application. they only copy and paste an answeres.

    i dont know ... but ever since i applied i always emailed them if i have something to ask and that is also the email add that you can contact regarding for visa

    lastlid is correct, they did not understand nor did they answer your question.

    Why not resend your request stating that your asked specifically about overtime and bonus payments notskills based allowances and not London weighting.

    Besides which, all they did was copy and paste the paragraph from the Annex 1.7

    Probably if they ever really answer your question all they will do is to copy and paste the relevant paragraph from Annex 1.7 which looks just like this

    Overtime, commission-based pay and bonuses will be counted as earnings from salaried employment.
    Hmm

    No, you're not stupid at all, THEY however are paid to be able to read the specific question and should be able to answer it.

    Then again, I sort of suspect it's a bit like asking the lady on the front desk of the garage what was the matter with your car.............she might be well meaning enough, but you'd be better off asking the actual mechanic. I mean - VFS might not actually know

    anyway we already know the rules .. my husband print the APPENDIX FM of the IMMIGRATION RULES as evidence that ECO mistaken for making his decision to refused my application ... and we got the letter from his employer that he can earn 20,100 pounds for annum with his overtime and bonuses ...

    we do the online appeal last night .. then my husband will pass our supporting documents today or tomorrow ..

    Well done.
    This is a key document.
    The employers letter must state about gross earnings not basic pay as it did previously.

    Please be sure to make every effort to send very clear messages that the ECO is wrong. Quote the refusal reason and also quote the Immigration rules.
    Send your complaint to everyone you can.
    Your local UK MP needs to be involved.
    Consider asking for urgent help from UK government Theresa May and Damian Green and ask for urgent response and solution.
    Send you message every couple of days to the Visa Section at British Embassy asking for an urgent answer. Send to the Ambassador also and keep sending until you get an answer.

    If you just sit back and rely only on the formal appeals procedure you'll still be waiting for an answer at Christmas.!!!!

    That's the way to go

    Better to get it resolved that way than go through all the hassles of an appeal and all the time it takes.
