    spouse visa expenditure

    Hi could somebody explain on a spouse visa application appendix 2 where it say monthly outgoings of sponsor does just rent/mortgage, council tax and secured loans need to be shown here and nothing else because my house is paid for so no mortgage I have no council tax to pay because I receive JSA and DLA and I have no secured loans so should £0 be put here but that bebthe correct thing to do many thanks...

    Hi Mark what number is that asking for monthly outgoing expenses?just had my visa and looking at my form i cant find the one you are asking for....

    Leen its the separate form from the visa application the appendix 2 form which is for the partner of settled person in the UK

    hey Mark are you exempted from financial requirement?if you are then you need to fill that one but since we are not exempted we did not answer that one...try to read it and from 3.3 you just need to select which category you belong,we fall under "Income from salaried employment"....u dont need to answer everything you just need to select which category you belongs...hope this will help you

    Hi Mark, Leen is correct. U do not have to fill in the part 4 questions if u are not exempted on the financial requirement.

    Mark, the best thing to do is to include your lowest living expenses and state what they are for. In doing that always bear in mind that despite any exemption you may plan you are still required to provide sufficient maintenance. This will be based on the current equivalent income support levels (current at £111.45 per week of disposable income = total income minus rent/council tax/secured loans etc - remember also that your council tax will increase with an additional person living with you.)

    If you will not go the exemption route then you will not need to answer that section.

    Sorry Terpe for not understanding this what do you class as living expenses do you mean food, gas, electricity, water ect or just certain things just confusing your help on this would be very much appreciated and if it is what I have mentioned do I still have to have £111.45 per week after these are paid or before. I just want to make sure that I can give my wife the best chance of a successful application by making sure everything is correctly filled out thank you...

    I understand your concerns and confusion Mark.
    As with many UKBA visa application forms the wording of the question is extremely ambiguous.

    The appropriate UKBA guide is really no help at all on this one giving this answer only "State how much of your sponsor’s monthly income is spent on living costs"
    Here's what I personally think.
    They are asking how much you spend each month on whatever it is that you need to spend your money on (that means everything).
    From this they can determine whether or not you are living within your means and also whether or not you can support an additional consuming adult in the household.

    Others may consider it's asking only for amount you spend on the very basics of rent/council tax and loans, and that all other expediture is non-essential should not be included.
    The difficulty I see is that if you only include rent/mortgage/council tax and secured loans etc and do not mention other regular expenses it will likely show on your bank statements and your declaration is neither true not appropiate.
    At best this would mean additional scutiny and potential delays etc or at worst it could lead to refusal.
    Don't forget that in this case the caseworker must only consider rent/tmortgage/council tax/secured loans etc. but does need to have an overall picture of 'living within means'

    But anyway, that's just my own interpretation and opinion, and so to counter this and leave no room for misunderstanding and refusal I strongly suggest you include an explanatory letter together with other documents as evidence that explains how you clearly meet the rules of the Immigration Directorate Instructions - Chapter 8 (Family) Section FM1.7a - Maintenance - Para 2 and Para 5 in relation to a maintenance and accommodation requirement in that,
    "after housing costs have been deducted, there must be available to the family the level of gross income that would be available to them if the family was in receipt of income support."

    I understand what you mean about living costs now Terpe I have no heating costs to pay or water as I have my father living with me and he feels obliged to pay them so the other part about writing an explanatory letter to say that after housing costs that I have an income of £175 which is correct and that I have a level above the gross income that would be available to us if as a family we were in receipt of income support is that correct

    My mantra is to always minimise risk. Wherever there is the potential for doubt always provide a brief explanation, point to the immigration rule and state you meet it.
    If that makes sense.
