It may depend on what your current visa satus is?
If you are on spouse visa then I think you will need a dependant visa, if you already have ILR then you could apply for ILE (indefinate Leave to Enter).
The appoval of the visa will depend on proving sole responsibility for your son, as he is using his father's surname.
