    Milton mum fights deportation that could split family

    THE mother of two young British boys faces being thrown out of the UK after falling foul of new immigration laws.
    South Korean national Ga Young is set to be deported when her current visa runs out on September 29.

    The new rules has really brought a big impact especially to those families who are torn apart and will be apart because of the changes and also to those new couples who are also faced with the income threshold problem.

    Yes Rayna, I thought just the same as you.

    What visa did she arrive on in March that expires in September that requires a new application for spouse visa ?
    Was it tourist visa or student visa maybe?

    The various news items around are not specific on that point.

    It's certainly not FLR(M) is it, otherwise she would be under old rules.

    I wonder if this case will be the one to challenge the rules? or if it will be challenged under EU Human rights for family life?

    Interesting case, but perhaps a lot of important details not reported.
    The legal eagles will not take it forward if this has other cloudy issues.

    Eight years is a long time to've been married ... for any woman to face separation from her husband and kids on the basis of the rigidity of the Draconian new *rules. Mind you, since the family has been back in the UK since March ... it's a wonder they didn't think to act before *these came into force.

    Seems there are a lot of "grey areas" that haven't been reported ... and which readers of this article may be unaware of ... ... otherwise it is surely the very type of case you'd have expected would've been pounced upon and challenged by the European Court of Human Rights.

    Having said that, we can only hope and for some sort of intervention that will somehow prevent this family - and others like it - being torn apart by heartless bureaucracy.

    looks likes she came on a visit visa, well looks like its their own fault , she needs the right visa and go by the rules, just like the rest of us

    Yes but that nasty Theressa May & UKBA only gave one month"s notice of the new rules (13th June)

    It's a self inflicted problem - they came here on a visit visa when they intended to settle

    Actually, it has been announced early this year that there would be changes to the family route, and they just implemented it on 9th July..affecting the people who would get to UK starting that date. If that couple on the first post applied for a correct visa when the wife got here in the UK, she won't be affected of these changes. Like what Dedworth said, it was self-inflicted as they chose to apply a visit visa and not a settlement visa when they all intended to settle here. Like everyone else in this forum, they have to follow the rules.

    Thanks Rayna, what I meant to say was what has happened since that original story. Did UKBA force her to leave UK or was she able to secure legal help to fight the case, perhaps under Human Rights.
