i'm on spouse visa(M). The reason i asked if there is anyone like me have a 3 years visa granted is that when we came back from Prague. The immigration officer said that we should check what visa i have because it is unusual that they give 3 years exactly visa. He said normally it is 2 years or more but not 3years.

Spouse visa(M). I was a student and was here 2009.

Being granted a Spouse visa from outside of the UK allows you entry to the UK for a period of 27 months.
The 'qualifying period' for application of Indefinite Leave to Remain (ILR) is 24 months.
You can apply for ILR 28 days before the end of the 24 month qualifying period of living in UK.

Being granted Further Leave to Remain (FLR(M)) within UK allows conditional resident status as a spouse to remain in the UK for 24 months (the qualifying period).
You can apply for ILR 28 days before the end of the 24 month qualifying period of living in UK.

The important information for you, is that in either case and provided your FLR is still valid, you can apply for ILR 28 days before the expiry of your 24 months 'qualifying period' anniversary.

Does that mean that i dont need to consume the 36 months they have granted me? As long as i had consume already my 24 months anniversary or 28 days before the 24 months anniversary, i can apply for ILR?

By the way, in my VIGNETTE it says, LIMITED LEAVE TO REMAIN in the UK.

If you have been granted FLR(M) then yes, 24 months for ILR.

But to be honest I'm a little puzzled by your current visa.
Are you sure you did not receive an explanation letter from UKBA describing the leave granted??

Limited leave to remain really means just that.
You're allowed to remain here in the UK until the visa you have expires. Period. No adjustments during that time.

There are actually quite a few categories of leave to remain.
Perhaps the UKBA made a mistake in your case. Would be well worth double checking with UBA what you have.
The only 3 years visa I can remember is with discretionary leave. This is a type of leave granted outside the immigrations rules. This is usually given on an case by case basis
and connected with human rights and family members.
Does this seem likely?

If its DLR (disretionary leave to remain) then you will not be eligible for ILR after 24 months.

I think you would be wise to re-confirm the basis of your visa and secure confirmation in writing from UKBA.

Hi Terpe,

I did check what visa i got and it is DLR indeed. Not sure why the've given me this type of visa. we even hired a solicitor before to work on our case because me and my husband doesnt know much about immigration law. And because my husband work is too stressful already and i was heavily pregnant that time and dont want my baby to be affected. So we just go with the flow.

I have read about what is DLR and how many years shld i wait before ILR, But i did read as well some that i could apply a month before my visa run out for ILR. So now im so confused which is which?
