Provisional Driving Licence 185 day rule

    Hi.

We want to apply for a Provisional Driving Licence for Rose. On the form it states:

"You can only get a GB driving licence if you are normally resident in the United Kingdom.
To be normally resident you must usually live in the United Kingdom for 185 days in each calendar year. Applicants who are not UK citizens or nationals of another EU or EEA country will not be considered normally resident if they:
    • do not have leave to remain in the UK, or
    • are in the country on a temporary basis without leave to remain either while awaiting a decision to stay in the UK or following a decision refusing such an application."

After a bit of surfing this seems to be related to applying for a Full Licence, not a Provisional Licence. Rose arrived here in June, so less than 185 days ago, I don't think this is an issue since we're not applying for a Full Licence and she is now permanently resident here. She now has her FLR(M) Leave to Remain. Does anyone know?

Also, can we actually make the application at a DVLA local office? Their website is not clear.

I will call them on Monday, but thought some of you may have been through this already?

    Thanks.

    Trefor,

What you have to do is get a form from your post office, 'coz that's what I did, then put all your details in that form, insert your photograph, etc..(there will be instructions in that leaflet anyway) then once everything is complete send it to DVLA swansea, with the docs needed and with your payment (postal order, payable to DVLA swansea £50)
After 2 weeks I got my provisional driving licence
by the way I am on FLR (m) visa also, just got it July this year.
    cheers..

Thanks everyone. We handed the D1 form in at the DVLA office in Oxford where they checked it and took payment. No issue with the dates/timeframe. Btw, they only kept Rose's BRP, not her passport, the DVLA office lady said they didn't need the passport. They sent everything to Swansea last Monday. Fingers crossed we get a present in the post at the end of this week.

Now I need to buy her some wheels, Rose wants to get an auto licence. I have a 5 series BMW which is auto but it is a little big, and the TVR is a manual (luckily). We're hunting for a Smart car to keep insurance down to help her build up a NCB record (and help with parallel parking )

Hi everyone. I just got my driving license. Also, my BRP has been returned safely. Im very impressed with DVLA's fast action about my application. Trefor definitely will be surprised and delighted. We're meeting someone from Worcestershire on Saturday for my smart car. Im so excited to drive again though nervous after failing road test 8 times in Dubai.
Kindly consider this message as a serious road warning

My license is only provisional and would start my lesson very soon. I think the more i drive the more nervous i get...hehehe. I completed 97 lessons in Dubai but unlucky to pass the test. Hope UK driving is a different story.
    Don't just try, DO IT!

Hehehehe you can make it. I was very nervous and scared on the roundabouts ang joining the dual carriageway, it shaken my legs indeed, but know, i found it very easy and relax, my driving instructor praised me for that, well it was my partner who taught me how to drive. The main thing on the test is observation, they will fail you for that. i did had 4 minor errors..Did you had your theorr test? If you had any, it will help you with all of the road rules and sign.. Well u driven in Dubai I have no idea if they have the same road rulles.. are you learning on automatic or manula? i guess its automatic, coz un mentioned about smart car..I bet you're still young so you can make it...
