    Application for spouse visa inside the UK

    Has anyone know if we can apply for spouse visa while inside the UK? I have read the homeoffice website and found that I must be outside the UK to apply for this visa category however, a newly acquaintance has told me that they have apply for the same category while his wife is here in the UK holding a visit visa a year ago but, they have been married for 20 years when they apply for it.

    no because your wife would need 'entry clearance' and you only get that with a settlement visa, also one of the conditions of a visit visa is that you will leave before your visa expires, and if your thinking of getting married on a visit visa, and if you do find someone who will marry you both, you will have again broken your conditions of your visit visa.

    because people have tired this, and bypassing the settlement visa, if you are married there is a good chance you will be refused a visit visa if your spouse is living in the uk, for applying for the wrong visa, after all if your married why are you only visiting ?

    Hi can I also ask something, is it possible to apply a civil partnership (gay filipno) married to a UK citizen from a student visa? Thanks

    Hi joebloggs, thanks for this info just as I thought, entry clearance (is the word)is required and I better go back to philippines to apply for spouse visa for myself there. The reason why Im on visit visa only is because, we never thought we would stay here for good. I met my scotish husband in UAE when we're both working there in 2004 and got married in the philippines 7 months after and have decided to stay in the UAE and work while we can till we have enough savings to buy a place to permanently stay but the president of the company where my husband worked wanted him to go to saudi which gave him no choice but to resign. He had some good offers in the abu dhabi and dubai and a few here in the UK so, after reviewing the offers we decided to come here in the uk while the company is cancelling my husband working visa and we'll comeback again to uae to grab the offer and I can continue my job in the gov administration but, so I applied for visit visa to uk only with the plan to go back to uae and apply later on for permanent settlement visa when we are ready for early retirement. as soon as we arrived here in the uk the plan changes as my husband just felt that he had enough of the uae and he feels so at home in his own country

    you could try and apply for FLR(M) but UKBA would not like it, and might well end up in a refusal and you could be waiting along time.

    there is no way that u can extend your wifes stay in the uk using visit visa. visit visa holders needs to depart the uk on or before the visa expires. getting married using visit visa is breaking the law as well and that might put your further application or extension at risk. she couldnt extend or apply flrm as well as she didnt enter the uk as a fiancee or a civil partner (see sir joebloggs 2nd link)

    she needs to go back to the philippines to apply for a spousal visa. i stand to be corrected but i think thats the only legal way she can do.

    Yes ... you're correct, Novie ... she WILL, unfortunately, need to return home and apply for a Spousal Visa through the British Embassy in Manila.

    Yeah, we're both came from the united arab emirates and was a resident there for over 10 years before we came her in late october 2012. I guess, based on what you guys have advised, there is no other way but to go back to ph and apply there. Anyway, it is always wise to abide the rules and follow what it says as we have never intended to bypass it. We have been a good citizens where ever we go and we'll stay that way.

    if your husband was already in the uk, you would have probably been refused your visit visa.

    make it easy for yourself and go by the rules
