Partner visa questions. Please help!

Hi everyone,

I am currently on a Family visit visa (Unmarried) and will be back in the Philippines in June and will then apply for a Partner (Unmarried Partner) Visa with a view to settlement. We pretty much have most of the documents needed and we just need some help with some questions.

1. My partner has a permanent job and earning above the required salary however, he hasn't got any savings as of the moment (disposable income). Will that satisfy the financial requirement?

2. In my Visit Visa application, we declared that we will be living at his parents' house and now we have just got our own flat, therefore, we will be declaring the new address as our accommodation, will that be a problem?

3. Once my visa got approved, what's the latest date that I could leave the Philippines after my supposed date of entry in the UK?

1. Yes it will satisfy the financial requirement providing you have the correct evidence to show proof of earnings. Any savings are not required in such a case.

2. A different address I can't see that being a problem, but make sure you have the correct evidence for your address as specified in the requirements (eg if it's rented, a tenancy agreement with more than 6 months left on it, letter from the landlord ....)... also if you have just moved in there you may need evidence of previous address/es so research this further.

3. 3 months from the date the visa is valid from. The visa is valid for a total of 33 months, if you leave within 3 months you will have met the 30 month requirement for the next visa (FLR).

We are renting a flat at the moment. We initially intended to get a 2 yr contract but they would only allow us 6 months, renewable at the end of each term. Therefore, when I apply for my visa in Sept, there will only be 5 months left on it. Do you think that's fine? Should we get a letter form the landlord stating how long have we been living in the flat?

Also, since I have changed my address now from his parent's address to the new flat, should I be informing the UKBA about this whilst i'm here?

Yes.
Hubby = Philippine CNI version issued by British Embassy
(maybe also CENOMAR - probably better just to get one anyway, rather than get a surprise)

You= CENOMAR

Your husband gets his UK CNI from the local registrar (takes 21 days min) then it must be exchanged for a Philippine acceptable version issued by the British Embassy ( by appoinment only)

From Article 21 of The Family Code of The Philippines:-

When either or both of the contracting parties are citizens of a foreign country, it shall be necessary for them before a marriage license can be obtained, to submit a certificate of legal capacity to contract marriage, issued by their respective diplomatic or consular officials.

(The highlighting was done by me and does not appear that way in the Family Code)

Most authorities issuing marriage licence's also request the foreign partner to have CENOMAR. It's better you will double-check at the place you will request the licence.

We truly appreciate your reply Terpe. But just to clarify, we have no intention of getting married (yet). I will be applying for an Unmarried Partner Visa in a few months. I am now in the UK on a Family Visit Visa (Unmarried Partner) until June and also sorting out documents we would need from here.

Perhaps what we would like to ask is, for Unmarried Partners (us) who has neither been married before, do we need to provide CNI (for my British Partner) and CENOMAR (for me) along with my application?
