Some issues n concerns with ILR before i start panicking.

Dear Everyone,

am raising some questions here regarding my application for ILR. I know i been asking to much questions lately but ill rather look stupid here than try to be smart and mess up my application,

as you all know, my visa was granted on June 29, 2012 and will expire on 29th of Sept 2014. I came to UK here in Cardiff July 9, 2012. I know I have to stay in UK for two years and somewhere of this forum for some reason i have thought that out of the 27 months i have to go out of UK and 24 months should be within UK. Terpe has clarified that to me that it should not be the case and I dont need to go out of UK. well I just returned from my trip and am starting to worry of my ILR application.

Question one; If i have arrived in UK tend days after my application and went out of UK for 13 days, can you confirm to me that there will be no problem with my application for that?
question two; What will happen if you have failed to apply 28 days before the due date for ILR application?


Sorry guys if i am being repetitive on my questions, i just need to be satisfied at the moment as i am working and i tend to be out of focus lately.

You are under what is termed 'old rules'.
Means you are eligible for ILR after 24 months living in UK.
You arrived in UK July 9th 2012
Means your 24 months qualifying period will be completed July 9th 2014
But you are allowed to apply UP TO 28 days before the anniversary date of July 9th 2014
Means the very earliest you can apply is July 9th minus 28 days = June 11th 2014

You spouse visa expires on 29th September 2014
Means you can apply for your ILR anytime from June 11th 2014 until 29th September 2014 (of course you shouldn't wait so late as 29th sept)

Concerning your holiday, don't be worried. there is no restriction on absences from UK as far as ILR is concerned.
It will only count when you apply for British Citizenship. Even then you are allowed 90 days per years out of UK
So no worries at all.
