Changes to the Immigration Rules - July 2013

Today, Monday 10 June 2013, a number of minor changes to the Immigration Rules have been published which will come into force on 1 July 2013.

They include:
changes to the documents required for approved English language tests;
clarification that 'regulated financial institutions' means those regulated to provide personal savings accounts or student loans;
more legal courses are now exempt from the time limit on study for Tier 4 student visas; and
a resident labour market test is not needed for applications for a religious worker (Tier 5) extension.


Other changes include:
some minor updates and clarifications to the family Immigration Rules;
changes to the list of financial institutions in Bangladesh and Ghana from which documents can be verified.
Tuberculosis screening is now required in more countries including:China;
Cameroon;
Ethiopia;
Gambia;
Hong Kong;
Indonesia;
Macau;
Malawi;
Morocco;
Sierra Leone;
Uganda;
Vietnam; and
Zambia.

Since most folk here will only be interested in Family Migration here are the changes relating specifically to those rules:-

- All references in FM-SE to the Financial Services Authority (FSA) are being updated to reflect its replacement by two new regulators, the Financial Conduct Authority (FCA) and the Prudential Regulation Authority (PRA).

- Changes to Appendix FM-SE are being made in respect of the Financial Requirements for applications from partners and dependent children under Appendix FM:-
- Allowing a pension paid by another government department or agency to be counted in the same way as the State pension paid by the Department for Work and Pensions.
- Counting cash savings in a pension savings account held by the applicant or their sponsor, whatever their age.


The following clarifications and corrections are also being made:-

- Spouse, civil partner, unmarried partner or same-sex partner applicants can still access pre-9 July 2012 routes if they have overstayed by no more than 28 days.
- Add a missing reference to “the applicant” in the Part 8 rule for leave to remain as a spouse or civil partner.

- Clarifying that the Part 8 route available in pre-9 July 2012 cases for limited leave with a view to settlement for a child of a parent(s) with limited leave with a view
to settlement can be accessed by a child with leave to remain who entered the UK by a different route, e.g. as a student.

- Applying the definition of “relevant NHS body” to the suitability provisions under Appendix FM which allow the applicant to be refused if they have failed to pay NHS charges of at least £1,000.

now here i am again..trying to push my luck lols..soon would be citizenship i hope before oct .. banging my head as one dependent and me me costa fortune just bhad ILR last year hope on my case Terpe aside from cash and paperwork i wont be worried that will cause my delay....
